Just follow the link below to register." This is what was in my case status online. Which location would be the National Benefits Center? Or are there more than 1?
  2. My wife had her biometrics on June 20 for greencard. The returned paperwork in July saying "Ohh you didnt make enough money HAHAHAHA", even though we had enclosed close to $100,000 worth of support between myself, and family. Go figure... We got an attorney, he said "OMG, YOU NOOB...WHY DID YOU USE I-864A's?!!??!!!?" So we used on family member, that made almost $30,000 to meet requirements. We mailed that off on July 13, overnight delivery. My wife is antsy to see her parents, and seeing as I lost my job recently, and apparently everyone in my hometown hates Asians, she wants to call this "Agency" that finds workers for Chinese restraunts, and go where ever they have work. Then save up for a few months, and go see her family. I'm all for visiting her folks. I don't care about that. My worry is, what if she's in China and we get one of those 1 week from today appointments like our biometrics were? I try to convey this, and she says what if the interview for the GC isn't for another year? Can anyone tell me, if the morons at USCIS get my paperwork straight, what kind of time frame should i expect from biometrics to greencard interview? I'd hate to see her run back to China for a visit, then have to throw all her $$ away to come back and HOPEFULLY be in time for an interview.
  3. I am really about ready to take a nap in the garage with the car running...I cannot describe the 3 years of $@$$@ this has been. My wife finally in the country, I think things will be good. A friend offers me a job, and for 4 months I never get paid. He declares bankruptcy when I try to attempt collecting on bad checks. I open my own business, landlord steals merchandise, I wind up spending 10x what I made to keep it going. I put a letter in the local paper asking for someone to give my wife or me a break job wise. Another local paper hires me as a reporter/computer tech. I file for AoS. I don't make enough money on my own, my parents agree to let me use them as household members. We send in the I-485 and all the $@$$ that goes with it. We go for Biometrics. During the time the I-485 is processing, a paycheck is returned as insufficient funds, then another, and another, and another, upwards of several thousand. When I inquire about that I am brushed off. My other coworkers are getting paid with a seperate account...I however, only get the bad checks. After 2 months with no pay, I quit. 2 weeks after quitting, I get an RFE, claiming that myself and my parents income was insufficient to support my wife. We have 87 days to respond with more evidence. I called www.Visapro.com , asking if they would aid me in filling out another I-864/I-864A and send it in. The lady informs me that you are only allowed ONE household member, or ONE joint sponsor, because there is only one blank for them to sign. She continues to inform me that I am stupid. When I ask why it is worded as househould member(s), and why there are multiple blanks under that area to list multiple members, and why it tells you to fill out an I-864A for EACH person contributing...not for THE person, she continues telling me, "SIR YOU CAN ONLY HAVE ONE SPONSOR". I call USCIS....long story short, after he reads off his screen, due to being incapable of making an independent thought of his own...he replies,"BLAH BLAH BLAH...I don't know if there is a limit sir, you can drive to your local field office and ask them." So I have to drive 6 hours to my local field office to ask them...so they can read off a screen...and say they don't know? I filed for the I-130 before, and they approved that petition...and the I-864 with multiple household members. For the last 2 years I have not made $@$$. I have no exscuse for that, between saving every $ I made to visit my wife that I had not seen for over a year, and working at 3 jobs that cost me more than I made. I have virtually nothing to show. I don't have the resources to hire a big lawyer, and I honestly don't think I give a rat's ass anymore. This is my last attempt at findining an answer before I just let her go back to China. I think she'd have a better life there anyway. She can't even get a chance at a job anywhere, one interview in over a year. She could have a good job/life back in China. How many household members can you have as people contributing income? Is there a comptent attorney anywhere that I could get help from in filling out a new form?? Would I be better off putting an add in the paper or asking at the local church for someone to sign as a joint sponsor?

Sincerely, The Department of Redundancy Department......" This is what they were sent...was going to call DoS tomorrow seeing as the weekend isn't over yet. Think of anyhting else I should do? Some of the wording, forms, and such may not be EXACT, her father doesn't speak english, and was trying to S P E L L it out for her on the phone.
  5. My wife came to live with me June of last year. We filled for AoS about a month or 2 ago. A few weeks ago I got a letter saying her K-1 had been fowarded to China for processing. Last week her parents got a letter, but we don't know what it says yet, they are faxing it later. She's here in the USA, on a K-3, already paid for AoS, got biometrics 6-20-2008. Why would they be setting up a CR-1 interview...and is this going to be a big mess? Do I need to just give up and take a nap in the highway? USCIS said I should have canceled the CR-1 after she came here on the K-3. What EXACTLY should I do? We're filing for AoS. It's cheaper at this point to just continue with it. I've already paid for it, I'm dang near broke as a result...seeing as my boss' last 4 paychecks have bounced. Do I call and cancel the K-1(cr-1), do I call and cancel the interview? What do I do and who do I call to straighten it out so I don't get bent over a barrel later?
  6. I have been reading lately they wont give EAD at field office, but they will contact NBC and get the EAD expedited, resulting in card issued in a week or two. Our EAD took 5 months, I called USCIS and asked WTF IS THE PROBLEM? It was there 4 days later. It was pointless to get the EAD, not one person in any of the local banks will even allow her a teller position, because she isn't "qualified" with 2 bachelor of finance degrees. While they themselves sit there with only high school diplomas. The only job my wife's had is at our local chinese restraunt, where she was only paid tips...all those massive buffet tips add up quick B) She was the only waitress, and bussed tables, 100% of tips were supposed to be hers, she was accused of stealing tips from tables...which i will swear to in a court of law she didn't. Most days she only came home with 10-15$. She wouldn't quit, no matter how badly they treated her, she wanted to help me pay bills. She was so proud of that small wage right up until the day the bosses fat, bloated, toad of a mother decided they needed the extra 10$ per day. My wife was unable to even bus the tables until the mother counted whatever tips were left first. I've since placed a call to the INS since I have found out his mother is here illegally.
  7. 1. Visa Number is the RED series of numbers on the visa page or the CONTROL number up top? 2. What status did you last enter the US?crewman, student,etc? I'm unsure because I can't find where it says which status on her paperwork. She is on a K-3. 3. Current USCIS status?

And you don't need the I-94 to file for AoS for a K-3 right? I just want to get this crap in the mail. Will she be issued a new one when she goes to visit her parents in China?
  9. Hi there! I got a bit of confusion going on here. I hope I can explain it well enough as not to confuse everyone else. I am filing for AoS for my wife. I have everything filled out and done EXCEPT the I-864 and I-864A. On the I-864, and I-864A. where it specifies annual income, is that the income from the previous year, or the projected income for the current year? I am using my parents income to qualify. They file joint tax returns. I began filling out my fathers I-864A, and came to the part where you indicate annual income, and income for the last 3 years. He is not retired, but receives Social Security Benefits. He is employed as well. Most of the Social Security Benefits do not show up as income on the Income Tax Form. For example, let's say he made $30,000 at work and $12,000 from Social Security and My mother made 30,000 at work. Their income tax form only shows the combined $60,000 from their jobs as income. The Social Security is income, but apparently already taxed or something *boggle*. So how would I write his income without it being returned to me as the amounts not matching when compared with tax return? It would either be $30,000 or $42,000 on his I-864A for 2007 right? How do I know which amount, or both amounts? I can't remember how I did this 2 years ago....yep 2+ years. Mom's was so much easier, one job, no benefits and such.

  11. This is for the AoS I'm filing, which requires a copy of the i-130 approval notice. Does it have to be a photocopy of the original notice, or will a copy i printed from the uscis website where you check case status be sufficient?
  12. Do you, or anyone know how I can optain a copy of the I-130 approval, other than digging through boxes of paperwork? We moved recently, and put alot of stuff in storage.
  13. We have my wife's employment authorization card, with which we did a biometrics. After sending in the AoS forms will we have to do another biometrics for that? Just trying to plan ahead. She wants to visit her parents, her mom is having surgery next month, and I told her it was fine to stay a while, just didn't want to buy a ticket for a month or 2 if a biometrics appointment was likely to pop up a second time. If it is necessary for biometrics the second time, how long after the AoS application being received does it "usually" take. I know it varies probably from center to center.
  14. Her English isn't perfect, but it is VERY good. I've never seen her have a problem understanding anything except slang or sarcastic remarks. She has an accent, but it's not bad. I have seen her have a little trouble understanding someone when they have a VERY heavy country type accent, for the most part she speaks and understands people as well as anyone I've seen.

We did look into it, but there were no openings. We've tried literally every business, tax, bookeeping, even a cashier at the local grocery stores, surrounding towns too. We haven't looked into anything like a cashier in larger cities, mainly because it wouldn't support us, seeing as I'd be back looking for work myself then. I've told her she doesnt have to work, but it seems to be as necessary as breathing.
  16. yea, we've tried monster, careerbuilder, asian-jobs.com, the usual stuff, i've tried the state employment office website and searched the whole state, even narrowing down by "chinese" keyword in hopes of something. my zip is 36401, small town named evergreen.
  17. I am unsure if anyone has posted anything like this, but I was hoping for a little advice on some job troubles. My wife has been applying for jobs in the USA for about 6 months, and has had 1 interview out of approximately 200 applications..literally. She has 2 Bachelor of Finance degrees, one from the USA and one from China. She cannot even get accepted for a bank teller position because "she is not qualified enough". We've gotten several letters stating such after applying, with the minimum qualifications listed being...basic math skills...and the ability to use a calculator. I personally know that several of the people that work in a local bank failed basic math in high school. I am very unsure what she needs to be qualified. I guess a lower GPA. When I go into the banks and ask the manager what qualifications she lacks...they say she is overqualified. She just wants a job in that will allow her to use her degree. She has virtually no experience in the field other than her degree. It looks like she won't be able to obtain any either. We currently live in Alabama, we'd be willing to move anywhere in the USA that there is work...she's really upset that she can't find employment and feels she wasted her parents money. They had to borrow quite a bit for her education and are still in debt. I send what I can, when I can, to help out. We don't have the money to fly and travel cross country to numerous interviews, or to just pick up and move to somewhere like California and search for work. Any suggestions would be very appreciated.
  18. ah sorry i didnt mention that. i filed the change of address thing last year before she even came. she was an exchange student on a J visa 3 years ago. she stayed with me a year at that address. she then went back to china for 2 years. i was fortunate enough to go there for 6 months of that time. my address changed shortly after she arrived. i have already filed and received the change of address receipt. i was wanting to know if on the 325a if i should use my new street name or the old one for her first stay here in the usa with me.
  19. This is just a simple question about which way I should put my wife's address on the g235-a form before I send the whole mess in for AoS. Our street was renamed since she was last here to make it easier for emergency services to locate residences, originally we had a rural address number like HCR 35 Box suchandsuch when she lived here. We are physically still in the same spot, but now it's J.P. Howard Road Box suchandsuch. I have come to learn that the USCIS ppl do not know the difference between their asterisks and a hole in the ground (found that out when I got the original I-864 form returned 3 months after they received it as INCOMPLETE...because I didn't put N/A in the apartment blank). I don't want to generate an RFE because something doesn't match. Should I enter the address as it now is, or just put it as I did when I originally filed. Hope that makes sense
  20. My wife just arrived in the U.S. We're looking at the 1-485 to begin filling out the paperwork for AoS. She is here on a K-3, and on the first page i'm already stuck. Which box would I check? Having trouble pulling up the website so I can put the choices down. It's the series of boxes that show what category you fit under as far as AoS filing. I thought the one about immigrant visa being immediately available, but heck i dunno. It asks for the visa number /shrug.
