  1. For the next step I think it's called packet 4 for interview, I thought we were suppose to get something in the mail. Packet 4 contains information like which hospital, more forums etc.

     

    Since I am the choice of agent on DS-3032, am I suppose to get it or my wife ? And it doesn't make a difference if I optin for scanning document to NVC. On the hand, it might be too early and to wait for something in the mail. My wife was extremely happy but shocked that it was so quick for interview.

     

     

    Note, I think it would be even faster by a week if I didn't wait to send the DS-230 with the other docs and a few days for other things.

    Damn, we just got an email stating they shipped everything from NVC to Guangzhou ( fast ) The interview is scheduled April 16. The medical examination requires a chest X-Ray. There might be too much radiation for the un born baby but was told it was fine. Unfortunately, we don't trust their option. Because of the baby, we cannot have a medical examination until after the is born. Therefore sadly, we will reschedule five months later. Will send an email to Guangzhou.

     

     

    Note, I opt for scanning documents to NVC instead of regular mail. NOA2 was Jan 23.

    Since you have not received your NOA2 from the I-130, it will be about 10-11 months for your interview. How did your lawyer get Aug 2012 and Nov 2012 for an interview date. From start to finish, getting a visa takes about 12 to 24 months.

     

    After the information is check at Vermont Center, you will be sent a letter for the next step. The letter is called NOA2. You need to read up and study what are the basic steps and process. Try these sites and this site.

    2. can i get an email confirmation on my status or they let me know when my wife actual date of the interview is thru email? if so at what point or what application do i fill that out with my email and my wife email address? can we email them back if we want to change the schedule date of the interview?

     

    Sorry I can't help you hear since I have not gotten to that step yet. I think it's package 4 when you interview date will be known.

     

    3. you mentioned, the next phrase of your nvc application, you email in all of your documents? what documents? is it proof of your relationship with your wife (i.e. emails, photos, airfare, phone bills, skype logs etc.)? if so how do you do it? do you print all of them in pdf and send it to them? if you have alot of documents, won't it be too much or file size it too big for them to accept?

     

    Next step after USCIS ( NOA2 ) is National Visa Center. You need to read up and what are the basic steps of the process.

     

    4. this question is specifically for anyone who had or planning to have a biological child in china while the father is a us citizen. did you give the child an english name or a chinese pinyin name for the us passport? can the child have dual citizenship (chinese and american)? if yes, can the child have an english name on his chinese passport?

     

    I believe you will have a birth certificate in Chinese. It can be either in Chinese or English for the baby's name. Then you have to register the baby at a US consulate. You need to bring a list of things, birth certificate, your passport, marriage certificate etc.

     

    RFE stands for request for more evidence ( documents ).

    NOA stands for Notice of Action.

  4. One of my friends just came CR-1 with his wife a few weeks ago. She is about five months pregnant. I know they waived some of the medical due to the pregnancy. I am not sure about the X-Ray. I know they were going to the ISOS Clinic in Beijing. That clinic used to do the medical for Guangzhou as well, if convenient, I might try to get the medical done there.

    The U.S. Centers for Disease Control (CDC) mandates that women who are both pregnant and required to have a medical examination in connection with the issuance of a visa must have a chest x-ray examination conducted. Pregnant women will have to provide the panel physician with consent to conduct the chest x-ray. For the health of the applicant and her unborn child, CDC instructs panel physicians and laboratories to provide abdominal and pelvic protection with double layer, wrap-around lead shields for pregnant women receiving chest radiographs. If you do not want to have an X-ray while pregnant you can wait until after the birth of your child, but you can not be issued a US Immigrant Visa until you have an X-ray and complete the medical examination.

  5. i file my i-130 with an immigration lawyer/guys back in dec. 2011 and got letter confirmation that they got my i130 like a week later. then i got another letter from immigration dated feb. 27 2012 saying they needed my 2 x 2 photos of me even though we have send that in my i-130. so i send in that 2 x 2 photos this week. my immigration guy told me if everything is going to plan, he is 100% sure my interview is in aug. 2012. do you think he is bsing me or telling me the truth? i asked him how sure he is on this and he said he is very sure. i'm expecting my baby in late aug. 2012. he said if i want an interview in nov. 2012, i should hold off paying the $88 till april 2012? now should i listen to this immigration lawyer guy or pay the $88 as soon as possible so i can have the interview in nov. 2012?

     

    It looks like you have not recieve your NOA2 because you just sent in 2 X2 photo for the I-130, is this corrected ?

     

    Sorry, you can't start the NVC process without NOA2. It took me over 6 months just to get my NOA2 but it could be ONLY 3-4 months to get the NOA2. It depends on what place your I-130 was sent and the amount of cases they have. My case was sent to The California Service Center and the process for NOA2 was over 6 months. So, you have to wait for the NOA2 and later a bill for the $88. Your lawyer should have a check list and caught the missing photo.

     

    Were was your I130 case sent to, What Service Center ?

     

    Since you have NOT received your NOA2, it would be impossible for an interview in Aug 2012. Just look at other people's timeline for their interview. It usually takes about 12 months or more, from starting to getting a visa.

  6. how long can she stays in china before she comes to the us after she pass the interview? the reason i'm asking is she is pregnant and is due probably around the time of the interview. i want the baby to be at least a month old before she fly over with the baby. how long can she stay in china after she pass the interview? thx in advance.

     

    My wife is pregnant too. The good thing, it is almost guaranteed we will get a visa and not to worry too much about a denial.

     

    We do have an issue with the medical check up. It is required to get a chest X-Ray. We do not want the X-Ray because of possible radiation to the unborn baby. Was told the X-Ray was ok but we don't trust the medical opinion..

     

    The medical will be done after the baby is born is our plan, We will continue the process of getting a visa now.. If the interview is before the baby is born, we are planning to reschedule. We know we might have to wait another 2-3 months if we have to reschedule, The baby is expecting sometime in mid to late July. We just emailed the scanned paperwork for NVC DS-230 and DS-864 is where our timeline is for the visa. From my estimates, the interview is possible in 3-4 months from now. It looks like we might have to reschedule.

  7. You might not like this, in my opinion, both of you are too young to get marry. Both of you are less than 24. She is only 21. The minuium age in China to get married is 20. For males it's 22. Wait a little longer before getting married. I would suggest waiting 1 to 2 more years especially when there is a big culture difference.

  9. Sadly, the authorities at PSB were not able to provide any written statement to issue the referenced document.

     

    I will continue to send messages till any response from GUZ consulate, I think that was some kind of misunderstanding that can be solved.

    And thanks a million for attorney info - that means our situation is not a dead end.

     

    Would like to know what eventually happened ? It looks like it will take a few weeks to get a Police Certificate so I have to start now..

  10. I planning to give 3 years of income tax returns alone with 3 years of transcripts. The income tax returns are about 50-60 pages for each year, planning to include both state and Fed. It gives a more detail information on what assets I have than the transcripts. The transcripts are only a few pages. I am currently not working, NO W2 for 9 years. I need to show more assets which I have. I don't think my tax account has PFD files for my returns.

     

    It would take me too much time to scan everything into PDF files.I have not gotten to reading or investigating what to do next exactly. So, I DON'T know if need to include the taxes returns, and other information, alone with the AOS ( I-485) and DS-230, etc. I need to study what to do next and I might end up doing everything electronically.

  11. I also called the National Visa Center 603-334-0700 using the automated system. Case not found yet. The time that I called was 11:10am PST Feb 1, 2012. My case is for I-130.

     

    I wouldn't pay any, or at least not much, attention to the AVR. Apparently it can take several days to update and in rare cases may never update. It seems it is far better to talk to an operator even if that means staying on hold for a while. :)

     

    As I posted a moment ago, I have my case number now. The AVR still says "No Record of your Petition."

     

    I just called them at 1:00PM PST. First check the AVR and no record. Then I called again and press "5" to talk with an operator. After waiting for about 15 minutes, I finally got to an operator. He said NVC just got my records today, He gave me the case number after asking some questions. Told me there was some missing info, strange. What was missing and I later added, was my email address and my phone number,

     

     

    I asked him can I go ahead with the DS-3032 ( Choice of Agent ). I told him I was planning to email the DS-3032 to my wife and she will forward ( email ) it to NVC. Everything else will NOT be done electronically. In other words by regular mail. He said he doesn't know and wait for instructions in about 2-3 weeks. Anyway, I am planning to email the DS-3032 later today to my wife.

  12. After prodding by my Congressman's immigration people, CSC has finally processed our paperwork at Day 175...

     

    Now to take the fight to NVC...

     

    USCIS+10 Days, and NVC still says they have no record of the case and haven't received it from USCIS.

     

    My NOA2 just arrived. The timestamp is Jan 23, 2012. It seems like you, foobaz123, took less time than my process at USCIS for NOA1 to NOA2. July 14 2011 to Jan 23, 2012.

    Your completely still within the expected timeframe. If it gets to 4 months since sending to USCIS then your having a bit of a delay. But I think a January interview is not realistic; as you have shown in your timeline, March is probably a good bet.

    ity and March was the latest. As things stand now, we're looking at April if not May/June.

     

    What do you mean by April it not May/June....You still have other things to worry about and to send in before anything else.

  14. I called the toll free number on Jan 6, 2011. Gave them my receipt number WAC???????? and the date of the NOA1. First he said it takes 5 month for the NOA2, the next step. Fpr my case it was still pending. I then told them it's almost 6 months. I was placed on hold for about 2 mins. He then tells me the 5 months is an estimate time frame. They are currently working on cases from May 16 to June 16, 2011. he doesn't know when they will get my case. If I had to guess, I would say it will take about another 1.5 months to get to my case since I'm at the end of the month for July.

  15. It seems according to some other sites processing at the California Service Center has slowed to a virtual crawl. Lucky me, I was oddly sent there. Has anyone gotten through there who filed on or about late July?

     

    I'm in the same boat. My I130 was sent to California Service Center. My NOA1 has a date stamped July 14, 2011. I am still waiting for NOA2. I have gone to their website and check my case status online. It says it is still pending. I will call them and fine out my status next week. It will be about 6 months then.

  16. --She will sign it at interview. Any style is fine. But theoretically should be her name in Pinyin. I did like that.

     

    --Put an address that she can receive mails from Guangzhou. If your and her apartment is not deliverable, then put a mailing address. It always is helpful if you can write the address in Chinese as well.

     

     

    I am assuming the G325A everything can be in pinyin like the address and names ? Is this correct ?

     

    We are planning to sign the G325A in both pinyin and Chinese.

  17. Here is the deal with chat transcripts, emails, and old fassion written letters, they don't read them, they do not have the time to do that. They only use them to see common language, they can be in Chinese or any other language and do not need a translation. You can blank out whatever for whatever reason.

     

    Logs is just a listing of times and dates you chatted or sent or received emails, in the case of emails just a list of emails.

     

    I kept a folder in my email that contained our emails and printed just the list, same with chat and skype logs. I then picked 1 or 2 emails per month and sent those nothing racy just common communication, and just the logs, and perhaps one or two chats.

     

     

    I tried doing a search first for the answer. The search function requires a longer sting than two characters. It doesn't allow me to looking for information on "QQ". I am planning to show the logs to as we communicate using QQ most of the time. In QQ you can see and speak to each other at the same time. I can speak a little Chinese but I can't read/write Chinese. She can't speak or write English. So we communicate orally. I am wondering is this useful showing the logs. I sometimes use a calling cards to call her because the Internet lines are slow during the night. I usually don't use calling card because of cost. It's $3 per card and $3 to print out the numbers. Don't know if these QQ logs can be modified.

  19. Question, Where are you in the immigrations process?

     

    I-864 and I-864A are used for Immigrant CR-1 and IR-1 visas or when Adjusting status from a NON-Immigrant K-Visa.

     

    If you are talking about K-Visa interview, you and your co-sponsor will be using I-134.

     

    OK I see your signature, so yes you will be using I-864, I-864A

     

    I got this from another website and I am just checking:

     

    The US fiance is ALWAYS the primary sponsor, but may have a co-sponsor. If there is a co-sponsor, both the US fiance and the co-sponsor will EACH have to fill out the affidavit I-134 or I-864 and EACH will have to provide supporting documentation.

     

    1. Both me and the co-sponsor has to fill out the separate I-864. Sadly I don't make 125% of the poverty level ?

     

    2. Is there a section on the I-864 to determine who is the co-sponsor ?

     

    3. After the I-130, it's DS-230 and I864 ? I got the NOA1 and NOA2. Sent in bills for I-864 and DS-230 last month.

  20. Don't confuse W-2 income with what you reported last year on your income tax return.

     

    Also- assets are counted - That bank CD , imo, should be fine.

     

    IF you need a hard reality check for 'hard assets' - go to a CPA friend, have him prepare a certified asset statement.

     

     

    Also have him prepare an income and expense statement which would probably give a more accurate picture of your situation.

     

    You have rental income. What else are you living on? If you don't know, get your accountant to tell you.l

     

    Sorry for getting back so late. I did not know someone asked some questions.

    My accountant would charge me about $100-150 to do expense statement. He's a CPA and my taxes were about $900 to do, expensive. I currently looking for someone else.

     

    I asked a few people like a lawyer and a pre-legal, the said it might be a red flag. Rental income is different from earn income. The rental income is only thing I have to live on. Well, I could find a job. :huh: The amount of rental income is fine but might be a red flag.

     

    As a result, we found a co-sponsor. The first one wanted some money. She was my wife's sister friend. I said NO and later her sister found someone else for th I-864.

    THere is about a 1 year deadline to return P3 materials... which now includes the notarial translations. but I won't say more till you clarify if this is the point you are at.

     

    The problem with the 1 year deadline, is some documents expire. For example I believe the police report is good only for 6 months and some notrization is good for a limited time too. I am not 100% sure but you might want to check.
