We want to know the minimum financial support requirement for K1 visa( I-134). What's the magic minimum number they are looking for? Is it 100% of the poverty line or 125% of it?

 

Recently I read something on the website and it says: (http://travel.state.gov/i864gen.html)

 

"Do applicants who are applying for an immigrant visa in a visa category that does not require the I-864 Affidavit of Support, such as the diversity immigrant visa, need to meet the public charge provisions of Section 213A of the INA?

 

No. Consular officers will review immigrant visa applicants whose visa categories do not require the I-864 under the public charge guidelines in Section 212(a)(4) of the Immigration and Nationality Act. The sponsor will need to show income at 100 percent of the federal poverty guidelines for household size, not the 125 percent required under Section 213A of the INA."

 

So from my understanding, for K1 visa, the tax return only needs to show 100% of the poverty line and for two of us the magic number would be 12,100. Is it correct?

The I-864 is required for family based immigrant visas ans some employment type visas. K visas are classified as non-immigrant visas where the I-134 is required. You or a sponser's annual income and/or assets need to meet or exceed the poverty line for the size family involved.

100% catagory for USC's in the military. All others, 125%.

The number is 125%.

 

The calculations are the same for the I-864 & I-134.

That would put it at $15,613 if neither of you have any children.

 

You can add in 20% of the value of your assets such as the equity in your home.

 

Thus, if you have 30,000 equity in your home, you can add $6,000 to your income figure when determining if you meet the minimum requirements.

 

If you are short on requirements, you can find a "co-sponsor" such as a parent who can fill out the affidavit of support (I think you need both yours and the co-sponsors).
