Step kids, to apply or not to apply, that is the question...

I am filling out the N-400... Obviously... Section 9 A. About listing kids.

I read the instructions and I still am not entirely sure what to put. I have 3 kids from a previous marriage. One is grown up and gone, other two are still living with me. My wife is the step mom and the one applying for citizenship. Do I put them down in this section? It says how many sons and daughters have you had. She has not had any, she is my kids step mom.... confused what to put.

I'm not positive but I'll take a stab at it. In the instructions for the N-400 http://www.uscis.gov.../n-400instr.pdf It specifically mentions stepchildren.

 

Write the total number of sons and daughters you have had. Count all of your children, regardless of whether they are:

  • Alive, missing, or dead;
  • Born in other countries or in the United States;
  • Under 18 years old or adults;
  • [Married or unmarried;
  • Living with you or elswhere;
  • Stepsons or stepdaughters or legally adopted; or

  • Born when you were not married.

I would include them. I was in a similar situation. I have 2 children from first marriage, 1 step daughter. The step daughter is with my chinese wife and living in china. I listed them all, and everything went fine.
