K-1 Fiance Visa help please!

Hello! I'm new here to this site, and have been searching around trying to find my answer. My Fiance lives in Germany, we have been together for over a year now. She has been here to visit in the States 3 times, and I have visited her in Germany 1 time. Were applying for the K-1 Fiance Visa, but I do have a little background to me. I have a Domestic Violence charge from 7 years ago. There was no bodily harm to anyone, I had tossed a bucket to the side of me, and she called the police during our fight. They arrested me and charged me with Domestic Violence only because our son was present in the room. This is a Misdemeanor charge also. I have nothing else for a criminal report and was wondering if this might cause problems with the Visa getting approved? Any help please! Thanks and good day to you all!

The domestic violence charge can and probably will derail the petition at USCIS.

 

Before starting this I would consult a very competent lawyer, one that we know is Marc Ellis, consult with him and get his advice.

One member on this site has been denied both a K-1 and is on a long hold over a CR-1 eventually IR-1 spouse visa for a similar issue.

One option, not that I suggest visa fraud would be to visit the USA and a few weeks later get married and then adjust status. Only issue with this is you will be interviewed, and if they suspect misuse of the visa waiver they can deny. Also in many cases they make a person visiting the USA sign a form stating that they will not attempt to adjust status, and then use this as basis to deny. This is a problematic approach with risks, so my stand is to say beware..
