Step Child steps to come to the USA

Hello to all,

 

My wife and I are 2 weeks away from filling I-751 petion to remove conditions on residence.

How fast time go's by!!

 

My wife has a 14 year old daughter that we would like to join us in the USA,

My question what do I need to file I-130, IR?, I filed a cr-1 for my wife almost 3 years ago.

Yes you will be filing an I-130 petition for an IR-2 visa for your step child, timing should be such that step child would automatically get a 10 year green-card upon arrival in the USA. US CITIZEN Files this, NOT green-card holder.. Citizen filing qualifies for an immediate visa number, green-card holder filing does not.

Should be able to file now, it is the timing of when step child get's residency status that would determine if gets conditional status or not. If your step child enters the USA after your second wedding anniversary, then the resulting green-card should be a 10 year card.

 

Processing the I-130 through to a visa interview should take at least 6-8 months.

 

Also study the electronic process at NVC that comes up after the I-130 is approved, this will streamline the process through NVC.
