I-130 packet for stepson

HI Guys

Its been a while. I love this website. It perfectly guided me through the process of getting Jin to come from China to USA in 12 months.

She is loving Florida, working, been through school, healthy and happy.

Now 3 years later we want to bring her son on a I-130. He is 17 and a good kid.

The delay was for his school.

 

My question is, since I am the petitioner, should I go to Guangzhou or should I send my wife, his mother who has custody to go to the interview.

 

Are their paperwork benefits or requirements either way or at JFK airport etc..?

Either petitioner or biological parent can be at the interview, but from what I have seen it is normally the biological parent that attends interview if child is under age.

 

Nothing special for the POE, the IR-2 visa holder will have a sealed immigrations packet that will be turned in at the POE. Immigrants do not need to fill out an I-94 card prior to arival at the POE unlike non-immigrants like K-1. K-2. Only paperwork to fill out just prior to arrival will be the normal custom's declaration form.

1. Can the petitioner attend the interview? No. Due to space and time limitations, the Consulate cannot allow petitioners to participate in visa interviews. In certain extraordinary circumstances, where the applicant would have difficulty navigating the interview alone (typically due to age or infirmity), an escort may be permitted. These are rare exceptions.

Due to the limited space in our interview waiting room, only beneficiaries may enter; the petitioner and other accompanying parties must wait outside. Children under 18 years old may be accompanied by one parent or guardian to the interview. Children under 14 years old are required to be accompanied to the interview by a close relative.
