The background investigation of K1 visa will attach great importance to the job of Chinese applicant? A unemployed aplicant can cause a bad impression to the U.S Consular officers? therefor making more difficulty to my getting K1 visa. I¡¯m a jobless woman at the present .And my fiance applied for his ex-wife 5 years ago and the later get green card successfully.They get divorced after a short marriage. Chinese immigrants agency of my city told me that the my situation is not in favor of my application. They say that the United States consulate may start a more strict investigation to my case., and the waiting time will thus becoming more longer. Is that true? The agency try to lead me to contract them in order to help me. But I¡¯m not sure if there is a necessary to do this.

My question is, I don¡¯t have a good employment background, and my fiance had applied for other woman 5 years ago. The background investigation will become extremly strict?

"Unemployed" is a valid employment status. Don't worry about that for a second. You are not required to support either yourself or your fiance in any way. In fact, my wife listed that rather than a non-verifiable job (helping a friend at a store) she had at the time.

 

Any investigation of your husband's previous situation would occur in the US - your Chinese agency can do nothing. Others have applied under similar circumstances - I doubt this will affect your application either. Your fiance should have front-loaded his application with a SHORT, factual statement about this. Even if he didn't, it will probably not delay your application.

I agree with Randy; the unemployed status is not that much an issue itself; although they may wonder if there is motive to wanting to leave china due to such circumstances. Also, the prior marriage may be seen as more filing related but my feeling is that GUZ sees this as a concern on some level. Back to back relationships through China (half way around the world) is as common as ________ . Fill in the blank. I agree that the way to over come that is as Randy says; that initial petition providing the circumstances. But if both relationships have the same M.O. I have personal feelings it may not be enough. I would get your husband on this website so we can also talk directly to him about such issues.
