can't handle missing him in cold

hello everyone

i am new here. and this is my first post,hope can get some help from you. i am a chinese girl (22) married an american guy(24) in july. i haven't met his parents yet,after the marriage he had to go back to the states for studying. early august we started applying for a green card. action accepted on 6th august . but they have not sent him the first package. is this normal that first step could take this long?

now more problems. next month,i am going to Spain to learn flying,start with PPL,it is about 6 months. is it a must to handy the package to embassy in person? which means do i have to come back for sending the first package? i am just thinking if i don't ,i can just get everything ready and leave to Spain,then mail everything from there. do u think it is gonna work? and usually what kind of papers will be obtained in the first package?

i heard it takes usually 1 year to the final interview. any idea about that?

First off Welcome!!

 

Now to give you a run down as to how this works, and what to expect and some options.

 

First off the US Embassy in Beijing has nothing to do with immigrant "Green-card" visas, you will eventually be dealing with the US Consulate way south in Guangzhou.

 

Sounds like your husband filed an I-130 petition for a spouse CR-1 immigrant visa to USCIS in the USA, he has received a receipt letter and is waiting for approval, this can take from 4 to 6 months, so should see something soon.

 

After approval the petition will be sent to another department in the USA called NVC where they will request an affidavit of support, your husband will then prepare an I-864 and send this to NVC, if his income is not sufficient to support an immigrant, he will need to get a joint sponsor who will also need to prepare an I-864 and send it along with your husband's I-864.

 

At this point you will need to prepare documents to be sent to NVC:

 

  • Police report from China + English translation, (You get this from the PSB where your residency is in China, "Home Town") Note these are only valid for 1 year..
  • If you reside in a foreign country for more than 6 months you will need a police cert from that foreign country, and or cities within that foreign country depending on the country.
  • Birth cert + English translation, (Again from notary office in Home Town)
  • Marriage cert + English translation
  • If married before, a Divorce cert + English translation

These things can be scanned to a PDF file and emailed to NVC.

Now depending on how soon you want an interview will determine how fast you prepare and send the above stuff to NVC, because typically an interview comes within a couple months after emailing or sending these documents to NVC.

 

1 year is NOT the norm, lately the time from filing a petition to interview can be as short as 6 months depending on how quickly you respond to document requests from NVC, and if you opt in to the Electronic process there, where you can stretch things out is by delaying sending things to NVC, just do not take more than 1 year or the NVC will cancel the case.

Don is right, but perhaps long text, here is summary:

 

1) Your husband should have received a single sheet of paper that says they received his package.

2) The time until visa is less than a year normally.

3) Warning, your husband seems to be a student and if his income is not enough will need a co-sponsor.

4) You need some documents from China, but they are good for 1 year so get them before you leave for Spain.

 

my additional thoughts.

5) Try to not be in Spain for 6 month before the interview so you don't need a police report from there.

6) You will have to return for the interview, and will need a few days before it to get medical check and put together paperwork.

 

 

Some thoughts for you and your husband:

One problem Chinese have at the consulate is proving the relationship is real.

If you marry, are immediately separated, and don't see each other until the interview, you will possibly not get the visa.

 

You need to spend the money to ensure you see each other at least 3 times, and try to spend time together.

 

He will be filing tax return in January, make CERTAIN you are on the tax form with him and he is filing married joint return. Even he has no income, this is required.

 

While he visits you, ensure you get pictures together with your other family. The consulate wants to know that you and he are together and that your appear as married in front of friends and family.

 

If his income is even close to being too small, get a co-sponsor. Co-sponsor is also proof that someone else knows your married and is willing to help you.

 

If you were ever a member of communist party, a special affidavit is required before you'll get your visa.

 

If he owns property in the US, add your name to it so it is shared between you in legal form, that also is additional "proof of relationship".

 

Have an explanation of why your in Spain, and anywhere else you have traveled.

 

If he has ever been married before, have proof he no longer has any relationship with ex-wife, and have the social security and address of ex-wife.

 

 

If he needs to talk to someone for help, I filed I-130 for my wife, did it all myself, and would be happy to call him.
