How long can you stay in China after K3 is issued?

K-3 has a TWO year validity, one of the few reasons I point people to the K-3 is in cases where US citizen may be living in foreign country, they can get a K-3 and wait until US Citizen's assignment ends, and then use the K-3 to travel to the USA.

I think what we discussed in a similar thread was that the K3 has 6 months to enter; but the visa is valid for 2 years of unrestricted travel.. that's why they require at least 6 months validity on the passport (for the first entry).

I believe if passport is valid 2 years or longer then can enter the USA at any time up to the expiration date of the visa, the K-3 is not required to enter the USA within 6 months after the visa is issued, K-1 is.

 

The requirement is to have a passport that has at least 6 months validity left when the visa is issued.

Gee guys this aint rocket science. You look on the visa. If it says it expires in 6 months you have 6 months to use it. Granted the customs and immigration officer may wonder why you took so long to use it if you wait too long.

The requirement is to have a passport that has at least 6 months validity left when the visa is issued.

 

The passport requirement is now 8 months until expiration.

On December 21, 2000, the Legal Immigration and Family Equity Act (the "LIFE Act") became law. The LIFE Act extended K visa benefits to the spouse and unmarried minor children of U.S. citizens.

*Six Months to Enter US After Visa Issuance

*Multiple Entries While Awaiting Green Card

*Immediate Eligibility for Work Permit

However this one nice thing about the K3 visa is no longer available it seems. I applied in the USA while living in China in order to get the K3 visa. Now that my case is finally at the NVC only my I-130 petition was forwarded to the NVC. The USCIS is now automatically stopping the I-129F if they are approved at the same time.

The "Four-Month Processing" is a joke, did not figure the customs delay for China.
