Can anybody give me links to the laws involved....

An interview for Removal of Conditions is actually not as common as one for adjustment of status, so if one is scheduled I would prepare for a Stokes interview.

Stokes interviews are where the couple are separated and questioned and the answers are compared. This is only done if they suspect immigrations fraud, and that the marriage is not a bona fide one.

Hi,

Call me stupid but I am not finding what I am looking for on these links.

I would like to see the actual "case law" that VO's use to determine approval or denial.

Can anybody help further?

PLUS... I READ SOMEWHERE ON ONE OF LINKS - THAT THERE ARE SOME SITUATIONS WHERE AN APPEAL IS NOT PERMITTED! What cases are considered FINAL with NO APPEAL at the time of denial?

Has anybody here ever had to appeal the decision on "removal of conditions" that can tell me first hand about what to expect???

Thanks,

FC

I have no idea where to find case law concerning immigration cases, perhaps a law library.

The IO's use 8 CFR as their guidelines for interviews of all sorts, the difficult part is the information is scattered around in various places.

Try taking a look at the Adjudicator's Field Manual

Chapter 10 - An Overview of the Adjudication Process.

Chapter 15 - Interview Techniques.

Chapter 15.5 - New York City District Office (¡°Stokes¡±) Interviews

Chapter 21 - Family-based Petitions and Applications.

Chapter 23 - Adjustment of Status to Lawful Permanent Resident.

Chapter 25 - Petitions for Removal of Conditions on Conditional Residence.

Chapter 26 - Rescission of Adjustment to Lawful Permanent Resident Status.

There is a large amount of information available, but this should give you a starting point.
