My question is, can she go back to China before she recieves her AP? And I'm wondering about how long it takes to get the AP? Will she get AP before her K1 visa expires? Thanks, AuggieWelcome to CFL, since a K-1 is a single entry visa your fiancee will not be able to leave and re-enter the US without a green card or advanced parole. I guess the reason I asked the question about the AP is because her daughter is not wanting to come to the US. She is wanting to stay in Liuzhou to finish highschool. I really don't want to seperate them for to long. Her daughter will maybe come to the US next year. Again than for the info and if you have any more helpfull tips we'd sure appreciate them Auggie Link to comment

The visa is a single entry visa, it is VOIDED the moment it is ues to enter the USA, the visa's expiration date is the date that it must be used by, and has nothing to do with AOS/AP/EAD process, the expiration date on I-94 has to do with when to marry or leave the USA. Again than for the info and if you have any more helpfull tips we'd sure appreciate them Auggie well, when does the school wrap up for 'next year' ? if within a one year 'gap' from the granting of the Visa in Guangzhou, then suggest she setup a K-2, follow to join, for the daughter. It might be 'tight', but at least do some projections on a calendar, with yer 'best guess' for the 'visa granting day'. Link to comment

Your daughter can get her visa up to one year after her mother's was awarded (what Sebastian called "follow to join"). Then she has 6 months after that to actually use it. Is 18 months enough time? No AP is needed, if so. Link to comment
