You were married in 2008 - it doesn't matter WHEN in 2008, or WHERE in the world you were on the marriage day, actually. 'Having a green card' doesn't change the fact that you married the man, or the tax filing status. The only thing that matters , for him to claim you as a dependent, is that you married, anytime, in 2008. INS/USCIS status doesn't matter.
