My Step Daughter will be graduating from college this summer. She is 21 now. She has a very serious relationship with a nice young man from Chongqing that she met in college. He is trying to obtain a visa here to the US for additional college courses.

What does Uncle Sammy require for her to get a visa? Since they may get married with in the year would it be better off marrying now in China or waiting and try to get a student visa or for that matter a work visa for her. Any help or ideas?

Your wife when she becomes an LPR may file an I-130 for her un-married daughter over the age of 21. The wait for a visa in this category is approximately 8 years. If your wife becomes a citizen, the category of the same application is changed to daughter over 21 of an American citizen, with a 5 year wait from the filing of the original petition.

 

As long as your wife is an LPR, her daughter may NOT marry (the petition would be voided). The daughter of an American citizen may get married while waiting for a visa number.

For either a student visa, or an employment visa, she would need to be accepted by a USCIS approved university, or get a job offer from a sponsoring US company.

For the student visa, she would apply for this herself. She would need an I-20 from the school (signed by school officials) she will be attending.

 

DOS - Student Visas

 

An employment visa would most likely be handled by the company that is hiring her.

I think what the OP was getting at is how can she accompany her husband after they marry if her husband gets a student visa. I don't know if there is a visa for spouses of students or not. If it were a work visa she could.
