another naive petioner

If you are working with M. E. then you should be good. Bottom line, it's gonna take at least a couple of more years so y'all might as well be studyin' up on each others' languages. I've been there, done that, and got a few Chinese T-shirts! :coolthumb:

Your CR1 will not expire as the K1s do so you are in for a huge wait. It took me 4 years from the time I met my now wife. BTW, how long did you know your woman before y'all married?

 

hey chilton, we met july 07 and maried in sept. 07. yup, red flag central in my camp. i hate when that happens, but aww heck it's water under the bridge now. yeah i'm start'n my t-shirt collection too, not to mention some l.j's,LOL , hoo wee it was cold there last go round. i sure wish i'da known about cfl 18 months ago. just gonna keep push'n forward. BTW ,if yourself or anyone else reading this has any "good idea's" on how to "find out" exactly why the case was denied {e.g. consular notes, the v.o.'s reason's for denial} i sure would like to know

but you had already been married for over a year when had the interview so time should not have been a problem. Did you live in china with her or how many times did you go to china to see her?

nope, never lived with my wife in china. been there 3 times in the last 18 months. my wife can speak some english. i make well above the poverty level guidlines. had tons of pic's , letters, emails. dunno, thats the mystery i'd like to find out. it seemed to me the VO was focused on the comminication issue, althuogh she never asked my wife to speak english, instead told my wife that she "could not speak english".{my wife told her twice, that she could speak some english}guess we drew the short straw that day.BTW we did'nt draw the "BLACK MAMBA" for the interview.it was the "WHITE MAMBA". i'd like to kick'r through the uprights. yup still a wee bitter. anyhoo thats a small glimpse. if ya have any info,etc. fling er' at me.

From the time of the initial application to the time of the interview does not count as far as relationship evidence. There is no way to send this documentation for consideration. It all has to do with the timeframe of meeting until marriage.

The thing that will raise a huge red flag is the timeline on a prior divorce. ie - you seperated for 3 years, meet yer lass - finalize divorce, then a week later yer married in china. IMO, that's a big red flag.

 

Others have overcome this, some with a blue slip, some had a white slip and refiled. For some others, even, it wasn't raised as any issue.

 

With that kind of red flag, again, IMO, a VO will ask some puerile question, like 'what is your husband's favorite soup?' , she'll get flustered, and BOOM ! white slip. The divorce time tick will not be mentioned during the interview. It may not even be mentioned in the NOID document (that you may not receive) .

 

These things vary, ya? So try, really really really hard, to determine WHY you got a white slip.

hey sebastian, thanks again for the LOL. {"favorite soup"}i be need'n that sometimes. never been married, niether has my wife. unfortunately, i had no idea of all the things necessary to "front load" my petition. only had some wed. pic,s and the single affidavit. yup, i got married the first visit too, only known her for three months. from the start we have used yahoo IM,webcams,emails,phone,letters.maybe the IM/webcam is part of the issue{it's damn hard to make an expensive phone call, when you can talk over the computer speakers for free} . dunno , i reviewed my wife's summary of the interview and the VO pretty much focused on the communication thing. i'm still try'n my best to peice together this thousand peice jigsaw puzzle. you and everyone else here have definitely helped a lot.

I had a new member PM me a few weeks ago. He also went through a long divorce. Just received his papers and was going to file. I suggested that he maybe hold off 6 months and then "decide " to get engaged. Then file the paperwork. Maybe this is something that should be stressed more in the future. I told him better a 6 month wait now than maybe years of waiting in the future. While yan had good english ability I really made it a point to take some chinese courses at a community college. Yan had a copy of my grades at the interview, While what I learned was far from having the ability to speak chinese to her. Perhaps this "mode " of operation would carry some weight with GUZ in dealing with this common language situation. Do es anyone think 6 month wait would still be too short before deciding to marry after divorce papers were received?
