rogerinca Posted January 23, 2009 Report Share Posted January 23, 2009 For any of you who have completed AOS for K-3 and K-4, I was told previously that for my K-4 wife, I check box 'A' on her I-485. I am now completeing the I-485 for my minor step-daughter. Is it box 'B' that is checked in Part 2, for my daughter's form ?? A. An immigrant petition giving me an immediately available immigrant visa number has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.) B. I am applying for an adjustment to permanent resident status because: My spouse or parent applied for adjustment of status or was granted lawful permanent residence in an immigrant visa category that allows derivative status for spouses and children. I hope to have both of these files off to Chicago in the next week or so. Off to get current P/P photos later today. Thanks. Link to comment

Thanks Randy, I was really debating back and forth which it might be ? I will wait to see if someone else chimes in here. ALSO.....since my daughter is only age 12, and does not need to have the Form G-325a, are the two PP photos which are normally attached to the 325a, not needed for her ?? Aren't these photos used on the green card, when it is produced ?? I read through the K-3 AOS Guide from VJ, and it is silent in this regard ?? BUT! since the I-485 lists the requirements of photos (initial evidence #4) in a separate section than the G-325a (initial evidence #13), I'd include the photos. Link to comment

No - the photo used on the green card is taken at biometrics. But, like David says, follow the requirements. Link to comment
david_dawei Posted January 26, 2009 Report Share Posted January 26, 2009 what you might do.. since I know you will do a cover letter with an outline of all inclosures you could get really pendantic (ie: code word for those who like to front load ) and when you list the evidence included, to note on that line which number it corresponds to in the instructions... I'm really looking forward to such an example cover letter Link to comment

I will include a set with her app' even though the G-325a is not required. If they don't need them, they can toss-em !! The amount of specific info for the K-4 filing for a child under age 14, is very limited within most informational venues, it seems. Link to comment

I did a whole lot of searches and this was the only blurb (a very recent thread on VJ) I could find with respect to that question. I read the I-485 instructions four times and it does not clearly spell this out.
