Had a interesting chat with a guy today who with his wife went to get her state ID card at the DMV. They took all the usual docs (mini kitchen sink) but were declined due to no "SAVE #" so they were sent to the dept of revenue to get that.

 

Any way the more intersting part is that he got it (state ID) but the expiration date is the same as expiration on AOS NOA-1, they were told this a new law and all states will be doing this by the end of 2009.

 

Any one heard of this ????

NOA-1 is a Notice of Action - there is no expiration. Do you mean the green card expiration? or the visa expiration?

I dont know Randy, confused me too, but my impression is that the ID will only be valid as long as visa is or after GC is received they will issue, but not while its "pending".

OK - that makes sense. You need a still-valid visa, or a green card - no more EAD- based ID's. And the ID will expire with the visa, or green card. That's in line with how some states were already doing it.

Actully NOT the visa expiration date, that date has nothing to do with evidence of legal presence, visa expiration is the date that it must be used by to enter the USA.

 

You must mean I-94 expiration date, I-94 conveys legal presence.

 

Many state DMV like NY require:

  • Valid EAD
  • Green-card
  • OR Valid I-94 card (NY requires the I-94 to be valid for 1 year (K-3 I-94 card))
  • SSN card WITHOUT the "Valid with DHS auth" notation.

Many set state ID to the expiration of the legal presence document.

 

One recommendation, make sure you get the SSN replaced with the Un-restricted one without the notation, after getting green-card, many states will accept the un-restricted SSN card and will issue the max length DL or state ID card when you renew the ID or DL.
