Name Change

Today Jing got her " Welcome to America " letter ... without the interview ... but now we need to know how to change her name.

We were going to do it when we went for the interview .... any suggestions>

The time to have done that (interview or no) would have been when you filled out the I-485.

 

Take her SS card and the marriage license to the SS office, and see if you can't get it changed on the card. Also her driver's license.

 

Someone else may have Florida specific advice.

You will need to file an I-90 and pay a FEE ($370) to change name on green card, or simply wait and when filing to remove conditions, you can file using preferred name.

 

My Yu took my name, and we filed our I-485 using married name, her green-card has her married name on it.

You're past the easy way, but you have 2 options to change her name with the USCIS and it must be changed with them before SSA and the state will issue anything in her married name.

 

This can only be used to change her family name, if she is wanting to change her first name it must be done in court then go to option 1.

 

Option 1, file an I-90 at a cost of $290 + $80 biometrics fee. It's a really easy process and is performed by DHS instead of USCIS. You can file on line and then you get a biometrics date. You will take your evidence of the name change to the biometrics appointment and the new green card gets issued pretty fast. Bring Notarized birth certificate, passport, green card and certified marriage license.

 

Option 2, wait until you file for removal of conditions in 21 months and do the name change on that filing.

She should be able to get it changed on her SS card by simply taking a certified copy of the marriage licence and her passport to the SS office. Next go to the DMV and get her a state ID card in her married name. For all intents and purposes her legal name in the US would be changed just like any American woman would do. When it comes time to remove conditions change it on her green card then.
