Questions on I-864

In item #23 it ask for your "Current Annual Income". Should this be your expected income for 2008 or your declared income in your 2007 tax returns? Unfortunately I was recently laid off from my work but I don't supposed to put down a big zero right?!

 

Along with I-864, am I supposed to also sent in copy of my '07 tax returns and the bank letter showing current balance (use of asset to qualify)?

 

For item #21, since my fiancee enter the US using K-1 and now we've got married, will that cause a duplication in checkbox (a) and ©? This is double-counting and I suppose you should only check either one.

#23 is Expected income for 2008 (Gross before tax and deductuions, AKA Salary) This should be the amount noted by employer on an employer letter, OR can be estimated from pay stubs.

 

Only are required to send a copy of prior year's IRS returns (2007, (1040+W2+1099)) OR a simple IRS transcript.

Bank statement is only needed if income is below 125% povertyline, and you are listing them as an asset.

 

#21 is quite simple, CHECK (A ) only, they are the IMMIGRANT being sponsored. (C ) is only for cases where you are sponsoring someone else like a parent, sibling, or child, in that case you count spouse as spouse. When sponsoring your spouse, ther are counted as IMMIGRANT NOT SPOUSE, DO NOT COUNT THEM TWICE.

 

Also for simplicity, if you are:

  • Sponsoring only one immigrant.
  • NOT using assets,
  • AND Not using a joint sponsor.

Consider using I-864EZ we did it was EASY to understand.

Since my income is well above 125% povertyline, and only was sponsoring my wife, I used I-864EZ

Thanks. I'm also a bit confused on item #8. Right underneath it, there are checkboxes for "Yes" and "No". I do not have a co-sponsor so I supposed to check box "Yes" right?

In your case I would be using assets, they will need to equal 3 times the 125% income if you were employed, ($52500) You cannot honestly fill in current income level when un-employed.

 

OR have a Joint sponsor.

I don't believe I can use I-864EZ since it requires a current employment letter to prove your salary. I was laid off since August 1st.

 

For estimated current income (item #23) I just adding up my pay stubs from Jan 2008 to end of July 2008.

In your case I would be using assets, they will need to equal 3 times the 125% income if you were employed, ($52500) You cannot honestly fill in current income level when un-employed.

 

OR have a Joint sponsor.

Well, when I add up my pay stubs from Jan to July '08, it's way over the 125% poverty guideline. So would this actually be better than simply put down your 2007 income under "Your Current Annual Income" on item #23?

 

To make things safe, I will also put down my cash balance in my bank account under ¡°Assets". My savings alone should able to qualify me under the 3x poverty line requirement.

 

 

Unfortunately, co-sponsoring is out of question for me :blink:

Yes you can list YTD income, and yes if asset in savings exceeds 3x125% poverty line you should be A-OK.
