RBrwnusmc
Hello, I do not want to worry anyone, But I went to my Senator's Office, To see if they can find out the status of my I-130, (It was mailed Aug. 30, 2007. It was recieved by the USCIS Sept. 4, 2007. Transfered to the Vermont Service Center. Was reveived by the Vermont Service Center Dec 21. 2007.) I gave the service Officer all needed information. And left. She called me by the time I got outside of the building. Stating that I had not given her the right Receipt number to the petition. So I went back up and she made a copy of My I-797C with the receipt number on it. She checked the receipt number, To find it was the same as the one I had given her. She informed me that she called the Vermont Service Center. To Check the working status of My Receipt number. But it was not in the Vermont active working system. She said that she would have them find my petition. and check the status. I checked back later that week and was told that my petition was pending with no more information.I called the Customer Service Center of the USCIS. spoke to a Immigration Office. She tried to check the working status of my Petition Number. And said that is odd. It was not in the active working system. She did a Service request asking Vermont Service Center to find my petition. And to enter it into the system and expedite the processing. Due to USCIS error. 2 weeks pasted and I received an reply from the Service request from the Customer Service Center stating that my case is pending, and there was no expedite request for my case. That was a week ago. I called the USCIS to get an address that I may send an Expedite request to the Vermount Service Center. And was directed back to the same Immigration as before. After reviewing her request and the reply I received from Vermont. Her again tried to access my case using my receipt number and still not in the active working system. But It is in the online status reporting system. So she refered My case to her supervicer. And Another request for them to find, and enter my case in to the active working system. also a request to expedite processing due to USCIS error. I was told if I did not hear from this request within 2 week please call them back. Can anyone tell me what i can do about them losing my petition, And What I can do from here? Link to comment
Guest Rob & Jin
wow, sorry to hear this Contact your congressman for a "congressional inquiry" into its whereabouts. Also the USCIS ombudsman to request they expedite it. good luck Link to comment
RBrwnusmc
Thank you for your reply. I contacted My US Congressman's Office. They did an Congressional inquiry. They replied back from the Vermont Service Center stating that my Petition is pending, With no other information. The Congressman's Office said they will keep looking into it. But no reply back from Congressman's Office That is why I went to My Senator Office for their help. I also wrote The USCIS ombudsman They said that the online status report stated that me petition was pending and that it was not out of normal processing time ( because the date has not changed in 4 months ) so they could not help me. Guest Rob & Jin
whats your NOA-1 receipt date ? Vermont has a processing date of DEC 18th, if your 30+ days past that then you are not in "normal processing time" Edited June 20, 2008 by Rob & Jin (see edit history) Link to comment

Sebastian
Did you send your I-130 to the Chicago lockbox address FIRST? I take note that things have seemed to go faster once the document collection gets initially received by the Chicago Lockbox address. So, It got shifted over to Vermont, but, __from__ where? You stated in your prior posts that you had filed a K-3 some time ago, with some interesting slippage around your prior __divorce__ date. Could it be that your K-3 status is whats holding up your CR-1/I-130 application? What was the final status of the K-3 visa application, and when was that __status__ issued? You also filed for a K-1 visa - what was the final status of the K-1 visa application, and when was that __status__ issued? i kinda feel bad - if I were in yer shoes, I'd feel like garroting the fools who gave you legal advice in those attorney offices. Did you, by any chance, have a change of address after you originally filed for the I-130 ? Edited June 21, 2008 by Darnell (see edit history) Link to comment
RBrwnusmc
The K-3 was for my wife, I filed I-130 and then I-129F. The I-130 was Denied I asked the USCIS to place the I-129F in abeyance so That I may supply new I-130 for the under lining petition. The USCIS agreed to do so. Filed new I-130 and was approved. I-129F Denied. So had to file I-130 for son. Now his petition has been lost by the USCIS. The lawyer That I hired first to handle the immigration of my family. He applied for the K-1 Visa. I could not get him to help me cancel it. So I canceled it myself. I have not had any change of address since I first started filing petitions with the USCIS. My wifes petition I-130 for IR-1 Visa. Has been sent to China for interview. Edited June 21, 2008 by RBrwnusmc (see edit history) Link to comment

Click on his name, the browser changes. Then in upper right corner, click on 'profile options' - then click on 'view posts' . Good Luck ! FWIW, it is very confusing. It's currently difficult to understand just what he is doing. I'm glad he at least mentioned that the I-130 for his wife was approved, but he didn't mention if he received any notice that it was sent to GUZ for further processing. His wife's son's I-130 is the one that's lost, near as I can tell. Link to comment

This has always been my gripe in trying to help someone who has no timeline and also doles out the facts, in confusing little 'cryptic' pieces !!! Sounds like there is much more to the story here !!??? Link to comment
Sebastian
Perhaps it's not lost? Perhaps it's attached to your wife's I-130 ? Call in to the DOS hotline number, ask about yer wife's I-130, ask if the son's I-130 has been attached to HER I-130 . That's about it for me, I don't know what else to suggest. Link to comment

Or maybe he could figure out how to go '3 column mode' . Tis quite confusing, at least to me, even in reading his prior posts. Welcome back, btw ! Link to comment
