Request for initial evidence

Hello everyone! After waiting for almost one month we received a notice in the mail and unfortunately it wasn't the green card! :D It turned out we didnt submit enough evidence for the Household member's proof of income ( I-864A). Which is my brother, anyhow. I finally have the employee letter which my brother gave me but it turns out there are a couple of things that kind of worry me now.

 

The proof that is required as far as the letter is concerned, is

 

Dates of employment: Assuming this is the date started and current status

Nature of job: That's a no brainer, the person in charge of typing up the letter made this point and clear.

Wages or Salary earned: That's evident , the monthly salary is clearly stated.

Number of hours per week worked: Not listed in the employee letter but they do appear as 7.5 hours during the days worked.

Prospects for future employment and advancement: This is worded so tricky but it doesn't really appear to be listed anywhere on the employee letter other than CURRENT AND ACTIVE EMPLOYEE.

 

Pay stubs: My bro has given me this.

The employee letter pretty much has four of the six requirements which are explicitly stated. The other two cannot be found anywhere on the employee letterhead. Also, the person who wrote this letter sent the letter to a totally different address which is definitely not an address we gave her.

 

Here is where my paronia begins, the last two requierments are not clearly stated although the person who wrote the letter says on the letter if further information is needed , they can be contacted at the following phone number. Now, the person who wrote the letter is the Payroll administrator,

Though, I was expecting Human resources to do it. Who knows. And also , the letter clearly states a certain address to be mailed , which is in Missouri. The person who wrote the letter wrote in the front of the employment letter head a totally different address to the department of Regulatory management division located in Washington, DC.

 

I'm a bit disturbed because I'm seriously concerned whether it can result in a denial of our I - 485 AOS. What does everyone think ??

Should I be concerned!

So you have a letter.

 

So your brother's company also hires inadequately trained humans, just like the USCIS office that's handling yer case.

 

Since you haven't mailed off this 'letter' yet,

 

GO BACK to the HR people, ask them to address everything you've mentioned here, and remind them that the form letter / template they used was NOT for USCIS processing, remind them SOMEONE made a mistake.

 

Do it quickly, ya?

I would read everything over very carefully to figure out what you are not understanding. 7 1/2 hours per week is not full time. Salary is annual, not monthly.

 

Did he submit tax returns?

 

"Prospects for future employment and advancement" sounds like they think someone doesn't have a full time job.

In my case Date I was hired ,position within the company,Made a point to say I had a full time permanent position. I was a valued asset to the company and chances of continued employment were good. Hourly rate of pay was mentioned. I also submitted 3 years of tax information. In this case it showed I had indeed been employed with this company for at least 3 years.

Basically, your employer letter should state "To whom it may concern: (first name,last name) has been employed

full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an

annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company

letterhead

Print this off and show them what is required.
