chilton747
My son's wife just became natualized and now she wants to petition for her brother to come to the US. My son told me of a wait for a number to become available of approx 10 years. Then I see the USCIS processing times for the I-130 for a brother is another 6 year wait. Does this mean that there is a total wait of 16 years? Link to comment
warpedbored
No, once you file then you are in line for an available visa number. There is a quota for these types of visa. A brother or sister is a fourth priority visa. This is from the USCIS website.http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRDIf the sponsor is a U.S. Citizen, they may petition for the following foreign national relatives to immigrate to the U.S:Husband or wifeUnmarried child under 21 years of ageUnmarried son or daughter over 21Married son or daughter of any ageBrother or sister, if the sponsor is at least 21 years old, orParent, if the sponsor is at least 21 years old.If the sponsor is a lawful permanent resident, they may petition for the following foreign national relatives to immigrate to the U.S.:Husband or wife, orUnmarried son or daughter of any age.In any case, the sponsor must be able to provide proof of the relationship. Preference CategoriesIf you wish to immigrate as a relative of a U.S. Citizen or lawful permanent resident, you must obtain an immigrant visa number based on the preference category in which you fall. People who want to become immigrants are classified into categories based on a preference system. The immediate relatives of U.S. citizens, which includes parents, spouses and unmarried children under the age of 21, do not have to wait for an immigrant visa number to become available once the visa petition filed for them is approved by USCIS. An immigrant visa number will become immediately available. The relatives in the remaining categories must wait for an immigrant visa number to become available according to the following preferences: First preference: Unmarried, adult sons and daughters of U.S. citizens. Adult means 21 years of age or older.Second Preference: Spouses of lawful permanent residents, their unmarried children (under twenty-one), and the unmarried sons and daughters of lawful permanent residents.Third Preference: Married sons and daughters of U.S. Citizens.Fourth Preference: Brothers and sisters of adult U.S. Citizens.Once USCIS receives your visa petition (Form I-130, Petition for Alien Relative), it will be approved or denied. USCIS notifies the person who filed the visa petition of the petition was approved. USCIS will then send the approved visa petition to the Department of State's National Visa Center, where it will remain until an immigrant visa number is available. The Center will notify the foreign national when the visa petition is received and again when an immigrant visa number is available. You do not need to contact the National Visa Center, unless you change your address or there is a change in your personal situation, or that of your sponsor, that may affect eligibility for an immigrant visa, such as reaching age 21, marriage, divorce, or death of a spouse. chilton747
Thanks Carl....ok as i see it, the I-130 processing times are approx 6 years behind probably because there is no hurry in this category due to the wait for a number. My son did see somewhere where there was an approx 10 year wait for a number to become available. I will have to ask him where he saw this unless you might know where to look.Makes since to me now as I did not understand before that the wait for a number begins when the petition is filed and NOT finished processing. Thanks again Carl. Link to comment

tonado
It took about 10 years for my dad sponsoring his younger sister. When she got her interview date 5 years ago, she was already in her mid 60's and retired with many grand children in China. It was decided that she would be better off living in China. Thus, my dad canceled her application. Link to comment

He is now in his early 30's so we will see what happens. My son's wife is Ecuadorian. Link to comment
