"Types of Social Security Cards Issued

When you receive a Social Security card, it will be one of three types:

* The first type of card is the card most people have, and has been issued since 1935. It shows the person's name and Social Security number, and it lets the person work without restriction. SSA issues it to U.S. citizens and permanent resident aliens.

* The second type of card bears the legend "NOT VALID FOR EMPLOYMENT." SSA issues it to people from other countries who are lawfully admitted to the United States without U.S. Citizenship and Immigration Services (USCIS) work authorization, but who need a number because of a federal, state or local law requiring a Social Security number to get a benefit or service.

* SSA began issuing the third type of card in 1992. It bears the legend "VALID FOR WORK ONLY WITH INS AUTHORIZATION." It is issued to people who are admitted to the United States on a temporary basis with USCIS (formerly INS) authorization to work.

It's based on her employment status - if she is authorized to work, she will receive one with the stamp "VALID FOR WORK ONLY WITH DHS AUTHORIZATION".

When she gets her green card, she will be able to get one without the stamp.

Employment authorization comes with either a K-1 visa, or an Employment Authorization (EAD) card.

A K-3 must apply for the EAD card before they are eligible for the SSN (I think that's right).

GREAT...why does k1 get EAD but not k3? makes absolutely no sense.

so applying for EAD is NOT the same as applying for AOS, right?

how long does it take to get this EAD crap done?

The EAD takes 60 to 90 days to process - file I-765, K-3's may file for EAD before filing for AOS.

thanks for the info...just amazing why i didn't expect more insanity just because she is here now.

""Will I Get a Work Permit?

Persons in K-3 or K-4 status and applicants for adjustment to permanent resident status from K-3 or K-4 are eligible to apply for a work permit while their cases (Form I-130 or Form I-485) are pending. You should use USCIS Form I-765 (Application for Employment Authorization) to apply for a work permit. If you are in K-3/K-4 status, you must submit the application by mailing a Form I-765 along with the $100 application fee to:

U.S. Citizenship and Immigration Services

Chicago, IL 60680-7218""

From above it says 'while the I130 is still pending', but mine is already approved. Do I still apply for I175 first before the SSN>?

Also, can I just call the USCIS to change my address over the phone, or do I have to file papers? I moved a few months back.

-You need to apply for the EAD if your wife wants to work. If she isn't interested in a job, then forget about the EAD. Save yourself some money. She can get the SSN after she gets her GC.

-You need to submit the change of address form AR-11. You're supposed to submit it shortly after you move; in ten days, I think. It's the law. The USCIS could make life miserable for you and your wife on that technicality, if they wanted to. Send in the AR-11 ASAP!

-You, as the petitioner, also needs to send in the change of address form I-865.

I thought I had to wait 90 days before our 2 year marriage anniversary before we can apply for AOS?

About changing the address, I thought i was told or read it doesn't need to be done until she gets here, which she just did last week. I was hoping to confirm that, but you say otherwise...

...tikc tock goes the clock...

so i'm changing my address using the online form and it says:

"U.S. Citizens who do not have an application or petition pending with USCIS are only legally required to notify USCIS of a change of address if they have previously submitted a Form I-864 on behalf of someone who has become a permanent resident. If you have previously submitted a Form I-864 for someone who immigrated to the U.S., you must complete a Form I-865 within ten days of the completion of your move.""

Mine is not pending, and I've not submitted an I865...so there doesn't seem to be any reason to fret until I subit an I765 or AOS docs, right?

before I got to the screen that says the quoted info(above post), i was presented with this screen that says:

"USCIS Online Change of Address

Case Status Online Check

Before we continue with the process to change your address for a pending case, we ask that you make sure it is still pending.

If your case was filed at one of our Service Centers or National Benefits Center, please check Case Status Online to see the latest action taken on your case to ensure that your case is still pending.

Next Step

Is your case still Pending?

* Yes, my case is Pending

* No, my case is not Pending""

the asterik choices are to continue (above post), where when I click NO, it is NOT pending (i130/i129f have been approved), it brings me to the above post's quoted info, which is a dead end...no button/link to continue with the change of address.

is this strange? does anyone know for certain that a change of address needs to be done if the petiions (i130/129f) have been APPROVED, not PENDING??

i know, i know, i could call my friends at USCIS, but that'd take out of my precious lunch hour.... :roller:

right after you login to the case tracker site(see my sig for link) it says this:

"USCIS Online Change of Address

Introduction

Customers who have an application and/or petition which has been filed with USCIS but has not yet been decided (also known as a 'pending' case) should notify USCIS of any change of address as soon as possible after moving.

The law requires nearly all non-U.S. Citizens1 to report a change of address within 10 days of moving by completing a Form AR-11. Abiding by these legal requirements and completing the necessary forms does not update an address on any applications or petitions pending with USCIS. Non-citizens with pending cases must do both.

Most customers can now notify USCIS to change their address on a pending case online here on our website. Non-citizens can also now complete the Form AR-11 online here on our website.

If you choose to change your address online using our Online Change of Address Notification tool, you will need to have some information available. Please have the following information available before you begin:

* Your receipt notice or other notice we sent you showing your receipt number (if you have a pending case with USCIS).

* Your new address

* Your old address

* If you have filed a petition for a family member, please have the names and biographical information for that person.

* When you last entered the United States (if you cannot remember this information please fill in an approximate date)

* Where you last entered the United States (through what port of entry you entered - whether by land, sea or air)""

clearly seems to indicate i, as a USC with approved, not pending petitions, do not have to change my address. thoguths anyone?

jesus, maybe i'm getting this whole thing wrong.

am i doing this for her or for me? i thought for me previously, but now i'm thinking it's for her.

i did move out of state AFTER both the i130/129f were approved, which means USCIS has my old addresses. Guz never asked my wife either. [end misc. info]

Because K-1 is entering the USA as a fiancee, to marry, and in many localities, in order to get a marriage license both parties need SSN, in fact there is a federal law on the books for that a is subject to a broadly varying interpretation from state to state, and county to county like in Minnesota.

Ok, cool, but i'm k3.

So do you know if i do a change of address? The path using the online form seems to suggest no, not for me I don't. But am I changing it for her? She's been here a week and hasn't moved of course since. using the online form it wants to know her old and new American addresses...the fields are for american addresses (e.g. drop down menu for state), so it seems it's not for her either, as she hasn't ever lived in more than one USA addresses, though the new address is different than the original address i used when submitting my i130/i129f.

I'm wanting to file the AOS and EAD this weekend before prices go up, but don't know if i need to change my address with USCIS first or not.

I moved out of state AFTER my i130/i129f was approved. And at my wife's interview they never asked where i lived at all, so basically nobody knows i've moved. those are some details that may be useful in understanding my situation.

Issues regarding moving are to keep track of:

- sponsored immigrating aliens

- sponsors (ie: you)

The AOS filing with your current address is fine...

Since you will provide a I-864 with AOS, any later moves will require both of you to file forms (she can do hers online but you have to do it via mailing).
