Tax Question

My wife and I have read through many of the topics here and Publication 519 but are still a little confused. My wife came to the USA on July 5, 2006, and we were married on Sept. 22, 2006. Can we do a joint tax return for 2006 or will there be problems. She passed the AOS interview in January but still has not received her green card.

As long as you were married on Dec 31, you can file jointly for that year.

 

Get her SS number if you can. If not, you will have to file a W-7 (I think is the form) for a Taxpayer Identification Number for her.

There is no problem with filing jointly, the definition of permanent resident for the IRS is different than the USCIS. To file jointly you want to consider making the first year election.
