What now?

I am at a loss. Jie still need to get to Shanghai before her grandfather passes on. THere is not a lot of time.

 

When she got her green card in November, it was incorrect. I called USCIS and they said to do the I90, and in the interim, go to infopass for the stamp.

 

We went to infopass on Dec 1 and as suggested on CFL, we took her green card with us (so I could not do the I90). The IO said "no stamp"....we have to send the I90 first, and bring the receipt notice when USCIS sends it.

 

So, we cancelled her Dec 3 flight at a loss of $150, and I sent the I90 with her green card on Dec 5. Having not received anything, I called USCIS again to ask where is the receipt. But first, I asked a general question: How can she travel?

 

Got the same response: go to infopass and get the stamp. I explained that the IO said I need to bring the receipt for the I90. The lady explained USCIS doesnt send any receipt or confirmation.

 

So, I am back to trying to make an infopass appointment, and there is no calendar for appointments.....'check back at a later time'. If and when I do get an appointment, what do I do when they again say "Bring the USCIS receipt for the I90?"

 

So, here I am: the USCIS call center says I can get the stamp at infopass. Infopass says I need a receipt for the I90. USCIS says they dont send a receipt.

 

I am at a loss. How do I combat this...and more crucial, in quick time so she can get to Shanghai in the next 2 to 4 weeks? If we do get another appointment, how can I overcome this issue with the IO telling us "bring us the receipt"?

I am guessing that this guy was very cruel in doing this.

 

Check up on the law, whatever similar cases you can find to back you up - bring the name of the person who told you they won't give you a receipt for the I-90.

 

Hopefully, someone will have some better information about how this should be handled.

 

And - can you apply for AP after receiving the green card? They should be able to give you this at an InfoPass appointment (more money for them, but something to consider if it's possible)

Since you said they didn't have any appointments available on the schedule you need to do this as a walk-in, expect to spend some time waiting and I'd get there early to get your place in line because those with appointments will breeze right by you until they have an open slot.

 

Take the copy of the forms you submitted and hopefully you have a copy of the green card. I'd make an extra set of copies for this. You need to reference the previous infopass appointment where you were given invalid info, it will be in the computer as to who you saw.

 

Now for the difficult part, if the person at the window will not cooperate ask to speak with their supervisor, be kind but firm and above all don't get pissed or pissy with them, if they get pissy or pissed all the better for you because it gives you a customer service complaint that can be leveraged against getting what you need.

 

Half the time I've done this in other situations the person tells me NO, at that point you get into a logic loop with them and request their name so you can reference them when filing your complaint because they refused to allow you to speak with their supervisor as you believe they have made a mistake in the situation and you want a higher authority to examine the case. Some will tell you that their supervisor will tell you exactly what they told you and that is their explanation as to why you are not allowed to speak with them. Remind them that you don't recognize their certificate in ESP and say you want to hear this directly from their supervisor. It's just a battle of wits sometimes to get the person next up the ladder, just hang in there.

 

The worst part is the USCIS does not open their windows on Fridays, or not in KC, so if it's this week you need to go tomorrow.

 

Hope you can get this resolved quickly, I know it's important.

It just kills me that one little mistake on the GC could cause someone so much grief. Like I said in your original post, I believe I would've used it anyways, but it's too late for that now. Now you're going to have to wait weeks, maybe months to rectify this thing.

Sorry to hear it but it is their fault. Not yours.

As usual, thanks for all of your help guys! Lee, your suggestion brought results this time...thank you! Since I could not find anything in FAQ's on how to do this, I made another thread that documents what we learned as being the correct way to fix a GC as well as get the stamp.

Happy things worked out, from what I understand the DHS offices in the consulate can not issue a new stamp, so make sure she gets back before the expiration date.

Yes, I agree, we intend to get an infopass appointment here in Denver a week or two prior to the expiration. We have a separate trip to Shanghai in March and will be back about 10 days before it expires.
