If I send in my I-129F tomorrow to VSC what would you expect my best case and worst case would be until the interview date? JK The petition is for Mainland China, i.e. Guangzhou. I am the one with the J1 visa 2 year rule. It is up in 10 months exactly. I've seen some people that are done in 8 months some in only 5. 2. Will the consulate issue a K1 visa for someone still subject to the 2 year rule (say 1-2 months left) with the thinking that a person will have 6 months to enter the US after the visa is issued and can thus serve the remaining "sentence?" 3. If you wanted to have the interview around July 2007 for China, when would you send the I-129F? 4. What would happen if I got through the entire process in 5 months and still had 5 months left on the 2 year "sentence?" Anyone know? 5. Who will take will Congress in November. Cathy Posted September 25, 2006 Report Share Posted September 25, 2006 I think for a J-1 visa holder, you have to finish up the 2 years residency back in your home country, say China, or, get a J-1 waiver from the American Department of State, to be eligible for another American visa petition. Both CIS and GUZ will check on that in your case. Link to comment

She was on a J visa, and subject to the 2 year home residency requirement. I was told waivers were all but hopeless. We decided to wait it out... The average K1 case is taking about 9 months...
