Hopefully I can get this 864 done and over with. Here’s my situation, along with my questions. I am sponsoring my wife, cr1, with help from my mother. Here are my questions. Any help is mcuh appreciated.

1. Would my mother be a co-sponsor or joint sponsor? Are they the same thing? Different? I have heard both terms tossed around.

2. Part I. Question 1.

I,___, am the sponsor submitting this affidavit of support because…

I have narrowed my choices down to a. or e. and not sure because of my mother’s role.
Would I be the sponsor and she a joint sponsor? Are we both joint sponsors of 1 person?

a. I am the petioner. I filed or am filing for the immigration of my relative.
e. I am the ___ first _____second of two joint sponsors.



3. Part III. Question 8

It says…

I am sponsoring the principal immigrant in Part II above and the choices are:
____ yes and _____no (applicable in cases with two joint sponsors)

Which one do I pick? Again I am confused as to how my mother and I are viewed.

4. In regards to meeting the poverty levels, if income makes the mark by a little, is that ok? Do “they” like to see you exceed the levels through assets, stocks, and other sources? My mother can meet the poverty levels through income alone for 3 of us, but not sure if “they” want to see more financial security. Thoughts? Any experience with this? My gut feeling is to provide more than necessary but just want to check. I was planning on landing a job and going through with the 864EZ form, but with my wife’s interview at the end of this month, I rather be safe, than bank on me landing a job before then.

1. The names are interchangeable... USCIS tends to use "joint sponsor" and consulates "co sponsor".. just to keep us correcting each other all the time. :lol: I prefer the former term, joint sponsor since that is what you will see in all the USCIS documents discussing it.

 

2. The USC is always the primary sponsor and fills out a I-864 themself, regardless of their income; Any joint sponsor is the first joint sponsor.

 

I think your answer should be "d" . [ She is the only joint sponsor]

 

3. YES, she is sponsoring [as a joint sponsor] the primary immigrant...

 

4. If you meet the guideline, you are all done; no joint sponsor is needed and the guidance is that one is not allowed if you meet it by yourself. They want to see sustainable income more than anything else; that income appears guaranteed to meet the guideline into the future; so income is the priority.

A few side notes:

 

- I assume this is for submission to NVC... I'm not sure that NVC has authority to adjudicate this form, I think that the consulate does... which could mean that NVC will accept your income if it is close to the guideline and the consulate might make a different request at the interview.

- You cannot use the I-864EZ form if using a joint sponsor. In this case, you might prepare one for NVC (if it fully qualifies) , but for the interview have an I-864 (one each from yourself and your mother) just in case..

- If you are living with your mother, then you can optionally treat her as a 'household member' and this changes some items on your form and it changes her form to a I-864a.. but I'll stop there since I don't know that this applies to you...
