Age Restriction K-1 Fiance visa

Recommended Posts

Hello, I have a friend who is interested in bringing a loved one over on a fiance visa. The man in China is only 19 close to 20. Is there any law in China that would prohibit that from occuring. I heard you have to be 22 for a man to marry but would there be any restriction for fiance visa? If not would the interview at the consulate be a lot more difficult?

Thanks

Jenny

"Upon receipt of an application to register a marriage, the civil affairs office will ascertain that both parties are of minimum marriageability age (generally 22 for men and 20 for women, although a higher minimum may be established by the local civil affairs office) and that both parties are single and otherwise free to marry."

If the person is applying for K1, the marriage will take place in US. So maybe there is no restriction.

The couple must be legal to marry in the location intended. I think all states allow marriage without parental consent at age 18. I can't imagine a Chinese male would be prevented from leaving China he was only 19. Why he's leaving is not really an issue.

If the two parties are brother and sister, a K1 visa will not work. CR1 and K3 are out of the question due to the inability for the young man to marry in China. I'm not certain but it may actually be possible with parental consent.

There is no such thing as parental consent to marry before the age specified by the law in China.
