  1. Thanks.. My wife still has the same name but probably will want to change it when she returns. I'll bring along our marriage certificate just in case..

    Probably would be a good time to do the name change legally at the time you file I-751 to remove conditions on a 2 year green-card. Or you can pay the extra $$ to file an I-90 to get name changed on green card if it is a 10 year card.

     

    Other time to legally change name is when naturalizing, at that point can change name as part of the naturalization paperwork, would save on any fees involved in a legal name change, and to replace a green-card.

    Did you mail using a trackable method? If you know it was delivered then you should be fine, give it a couple weeks.

    Yep, it was delivered and signed for the very next day. I'm starting to think that my SO will need to get the full medical check again. Hopefully it doesn't take much longer.

  3. Here is the kicker. That's how it is supposed to work, however the short expiration date set by the US consulate, more than likely exit control in China does not understand this and will bar exiting the country. For all intents and purposes you have an expired visa and should not travel until you have green card or AP. I would not travel with an expired visa, the I-94 only indicates allowed time in the USA before filing AOS, I-94 is not a travel document, it is an arrival departure record.

     

    Note I-131 says AP not needed by K3 as long as K3 is valid.

    I believe the visa had a short expireation set because you had an approved I-130 sitting back at NVC, there was no reason to issue a long 2 year K-3 because the I-130 was already approved, the expectation was for you to either move with the CR-1 case and make an intervier for CR-1 and perhaps use the K3 to visit and return to China for CR-1 interview or simply not use the K3, or immediately adjust status after ariving on the K3.

     

    The K3 was derived at a time when it was taking years, not months to get an I-130 approved, it was offered as an option to allow a married couple to be together while they wait out the year or so processing time for the CR1 or IR1 spouse visa petition. The K3 would be set to have an expiration time of 2 years because of the unapproved I-130, to allow travel.

     

    If it were me I would have moved with the CR1 once the I130 was approved and sent to NVC and forgotten about the K3 my wife would have gotten her green card upon entry to the USA allowing travel and work and save the added $800 in AOS fees. Or immediately did AOS shortly after arrival.

    Unfortunately your I-129F/I-130 were approved before NVC began their policy of closing any I-129F that they received with an approved I-130, they started that practice last February.

     

     

     

    Should I have waited close to our 2 year wedding anniversary or do AOS shortly after arrival?

     

    I'm not sold on the the expiration date of the K3 VISA, since it clearly states its a K3 Visa type with a two year expiration date on the stamp. The VISA itself had a 6 month expiration to use/exit china. But I do agree and worry about her having a problem leaving china. It can be somewhat confusing to anyone especially china customs. I'll certainly post what happens if we decide to take the chance.

  4. I need to travel to China next week and would like to bring my wife. I'm still a little confused if my wife can travel or not with the I-94 stamp on her passport or will they go by the visa expiration date?

     

    Her stamped passport states K3 admitted on July 5th, 2010 and is good until July 4th, 2012 with her A#. Her original visa from GUZ only had 6 months of use and it was my understanding she just had to leave china before the expiration date and not to determine the expiration date for her to travel back and forth after she had first arrived in the US.

     

    We have started the AOS process and should be only gone for two to three weeks.

     

    The Instructions for the I-131 does state that as long as she is a K-3 spouse of a US citizen, she does not need to apply for advance parole to travel abroad.

  5. Is Part 3. Question 8 only when there are two joint sponsors? Or do I need to check off Question 8 and indicate Yes below? I will be the only sponsor for my wife.

     

     

    Part 6. Question 23: How many pay stub(s) should I include to show evidence of my annual income? It says to cover six months, can I just include copies of my first pay stub of last year to the most current pay stub or do i need to include everyone from the last 6 months?

  6. No police report needed for Adjustment of status, it is not required by the form's directions.

     

    USCIS already has the medical on file, it was delivered to them by you at the POE, it was in the brown envelope turned over at the POE. K-Visas only need vaccination record transferred to an I-693 by a US Civil Surgeon. K-Visas would need a full medical if the one for the visa happened more than 1 year prior to USCIS approving the AOS, so in some cases USCIS will request you to do a full medical before the Adjustment of Status interview, this will be noted on the interview appointment letter.

     

    Copy of I-130 approval notice needed, this is the basis for the adjustment of status. If K-1, this would be the I-129F approval notice.

     

    Yep everything together to Chicago PO box specified by the I-485.

     

    Yes a cover letter detailing the contents of the adjustment of status package.

     

     

     

    One more thing, do i need to include a copy of the marriage certificate?

  7. Almost done gathering everything together just a few more questions:

     

    If my SO has no criminal history do I need to include a copy of the translated police report?

     

    Do I include a copy or the original medical examination report along with the I-693 and vaccination sealed envelope?

     

    Is a copy of the I-797c I-130 Notice of Action needed, is there anything else that should be included from filing I-130 or I-129?

     

    Is the USCIS Chicago lock box address correct when sending I-485, I-765 and I-864 together?

     

    Should I include a cover page outlining everything in the packet?

  8. I-693 Questions:

     

     

    Is there a link of what vaccinations my wife is required to have?

     

    What forms do I need to give the civil surgeon? Will the Civil surgeon need to see the medical examination record, vaccination documentation worksheet and the International Certificate of Vaccination, Sealed X-Ray Film?

     

    When submitting the I-693 will I need to include anything like the Medical Examination Record (copy or original), Vaccination Documentation worksheet (copy or original), International Certificate of Vaccination, X-Ray Film or any other documents from Guangzhou?

  9. Hello All,

     

    How has everyone been? I'm happy to report my wife has finally got her drivers license after four attempts. It really amazes me that she could get a drivers license, health insurance and enrolled at the university as a resident of Arizona with only her K3 visa. Time to start the green card process.
