  1. Correct me if I am wrong but, when submitting passport stamps as evidence doesn't one need to submit all pages of the passport(even blank ones) and every page notarized?

     

    E.G. The following is an unaltered copy of Mr. Dolomite passport. (On every page and notarized at the local bank)

     

    Anyways that is what I did and USCIS/NVC/GUZ had no problems.

     

     

    Compleate copy of passport is recommended by petition instructions if using passport as evidence of US citizenship. You have other evidences of trip to China, (Credit card receipts, ATM receipts, Hotel receipts.....)

     

     

    That's right now I remember. In our case I had 3 trips before marriage and I sent in the I-130. Copies of passport pages with stamps,and visas. Maybe I sorta killed two birds with 28 pages of passport.

    Poor girl is stuck with me now.

    Two things stand out from your post to me.

    Hell! I wish I could have mine go visit for 4 months.

    4 months I could drink beer, smoke in the house, walk inside with my freakin shoes on, eat pizza, burgers everyday. 4 months of no phone calls at work "I needa yoooou do this and this and this and that". "NO BE LAZY MAN!!"

  4. I have a 15 year old daughter who's exactly the same. And she was born and raised in the USA. But she's carrying a 3.75 grade point average in school, had a wide social group, and doesn't smoke, drink, or do drugs, so I cut her a little slack sometimes. Maybe too much. My only advice is to choose your battles carefully. Some of them you can win, others you won't. Just make sure the ones you win are the important ones.

     

    I know I know nothing like being an ass over nothing.

    I've been thinking the same.

    I don't want her to grow up a 300lber and can do nothing but cook and clean.

     

    For the record she is a great classical pianist and brought Western culture to our home. Go figure that one? It confuses me too.

    Beethoven, Bach, Mozart, Chopin I want to buy her a go-cart and watch her get muddy.

  5. I think you will have to take the bull by the horns and also get momma to support you and open her mouth. Your list looks right to me. Spend at least some time by the piano while she plays, even though you can hear it all over the house. When away from piano compliment her somehow, even when bad - it gets better. Do as much with her as possible or have whole family do a lot together. Then she can regulate herself a little better.

     

    I had a long time gf who would do NOTHING to help her daughters in life. I explained THINGS, and was out dragging one home when she was 12/13 late at night. The mother just didn't have it in her to tell her kids no on anything. You may be in a soft version of this. Maybe Momma just does not see the harm in it or who knows???

     

    As far as outside stuff maybe do it with her, or get momma to do it or all together. This way she is not lonely and gets in the habbit of outside and learns things. I would limit the computer time too. Our Lil One will LIVE on computer playing games and regularly gets in trouble by her Mom if caught. She is suppose to be learning math on there.

     

    My situation is quite different. Momma here is all over Lil Ones ass. Momma is an over achiever with 3 college degrees and crap. Lil One loves to read books so she likes flashlights to read by until 2-3AM she has told me, then she gets up early to do homework, when Mom won't see her. Niether one of these women need much sleep. I found out Momma didn't turn in homework either in school growing up, because she made great grades on tests, so she makes her daughter do the opposite and daughter wants to not turn it in.

     

    In the long run your daughter will THANK YOU for making her do the right things. Teens want parents to make them do the right thing, even if they throw a fit or rebel and sneak to do the opposite. Even the girl I raised that I had the most trouble with tald me when she was 13 that I was the only one who made her do right (that was pay day ), and when married she wanted me to walk her down the isle, and even today she sends me a fathers day greeting and on my brithday and other holidays. I am touched. I was never her step-dad, but in my heart she is my daughter, and I seem to be her Dad - what an honor!

    Yeah that's the thing I used "step-daughter and step-dad" so folks would understand that she is Chinese and I am American. She is my daughter too and I have became very proud and fond of her and her Mother. They are like carp, I dragged them here from China and yet the refuse to die and eat everything.

    I'm just worried about her health and want her to bring her butt OUTSIDE!

  6. My step-daughter is 14 doing okay in school but behind in English. None of her friends live near us, I see no school books or library books at home. She does help clean house and cook for her Mother and I and for the most part is not a brat I would say normal 14 year old teenager.I think bedtime of 10:30 school night is fair 12:00 on weekends, 1 hour piano practice each day. I have set up a basketball goal, we have trails she could hike, we have animals, vegetable garden and flowers. She is happy but will not go outside for nothing very long. She stays on the computer all day and night after 2:00am and often on school night I must threaten to unplug the computer for her to finally go to bed. If she is not on the computer then she will sit and watch Chinese TV all day. She is getting bigger than when she first came here and I am also worried about her diet. We get along fine no fights just normal everyday family stuff and I would say she is a great daughter. I know I am the step-dad talked to the wife about this we agree on this or that and she will not follow up with her daughter.I am no tiger step-dad.

     

    Am I out of line?

    1: Three hours computer/TV time school night and four on weekends.

    2: Bedtime is 10:30pm on school nights and 12:00am on weekends.

    3: Must find interest/exercise outside.

    4: One hour piano practice each day.

  8. Ok... despite some success stories on the internet getting their banks to "let it slide" by on a deposit, the Bank of [no service] America said to forget it. They all but said you can tear up your refund check or use it as TP

     

    I talked through 3 levels of IRS and got through to a legal tax code person. Long story short, they said the safest thing to do is to file as: Married filing separately. I asked if I can amend it later to be as Married filing jointly to realize the refund difference lost and they said 'yes'.

     

    So... If I file, Married filing separately:

    - No need for ITIN #

    - No need for power of attorney (form 4838)

    - No need to stipulate her as a nonresident to be considered a resident (Publication 15)

    - No need for form 2555 to exclude her income

    - No need for a check with two names

    - No need for Bank of America to show the slightest understanding

     

    I can amend later if I want and then I'll need to do most of the above.

     

    Honestly, this situation is apparent to many, many people for many, many years. I am surprised to never hear of it being raised; or I didn't pay attention.

     

     

    Sorry About that David, I must have got lucky. btw I use a small local bank.

  9. Here is what I decided to do.

    1. I put together a letter like Whatsthedeal showed; very nice ! It has the required comments of election and her info, including her income for 2010. We will both sign it. This will be used in support of filing form 2555 (Foreign Earned Income Exclusion).

    2. I will file form 2848 (Power of Attorney and Declaration of Representative) as tsap seui did (damn... he is good for something). I will use that so I can sign her name on the tax return. By association, I will use that to sign her name on any tax check, should I need do it. There is a place on that form which allows the person to request their power of attorney NOT to have the ability to cash a check; ergo, left unchecked means they can cash the check. That's what I'll argue should it come to it.

  11. I had my wife sign her name in pinyin on all documents. She was coming to America and signing Chinese would cause her trouble down the road so why not start from the beginning. And of course since she has been here she continues to do so, so it's no big deal to her now. And yes inverted, given name then family name.

     

     

    I agee with Charles I mean cuzzin ORD.

    Had my wife start to sign in pinyin and if asked for alias always used Given, Sur and my Last. Now she is here and signs all things with my last name.

    I really appreciate all of your support during a stressful time. I hope that sharing our experiences can someday repay the favor to others facing the same challenges.

     

    What is your collective wisdom about going to family court in China? Wife and I are considering asking a judge to change the divorce decree visitation terms to clear state my wife and stepdaughter are moving to the US so birthfather can see daughter at CNY and summers. Would a court order help offset not having the birthfather permission letter? Anyone try this?

     

    Still can't sleep well, hard to enjoy the rest of my life, can't passively accept that what will be will be...

     

     

     

    An interesting exercise - with all we hear about the hurdles GUZ places in the path of those trying to get visas for family members, we have someone creating his own hurdles.

    David, in the new letter to K-1/K-2 applicants, that has been sent to Don, they cover this in the Submit these items during your interview section:

     

    For applicants 17 years old or younger, documents showing that the principle applicant has legal custody of the child, or a notarized statement from the parent who has custody giving permission for the child to immigrate to the U.S. Only children with divorced parents need to submit this document.

     

    Okay TST, Take a deep breath and relax. :D

    The last thing you want now is for your anxiety to spill over to your wife. I sure you understand what Randy and others here are telling you (you have a divorce decree that clearly spells out custody to your wife.) TECHNICALLY that should be all GUZ will require, your efforts might stir the ex to contact the Consulate and try and block your petition.

    Now when your wife speaks, fluent english, well.......just one little missed un, or n't, or some other part of a word can reverse the meaning. Maybe you didn't hear her correct or she didn't hear you correct, it goes either way. This can cause an argument, a great argument.

     

    Her knowing english makes for very frustrating conversation, thus....listen and umm-hmm as much as possible, but LISTEN otherwise she asks if your listening and asks you to repeat what she said. You repeat, but she can tell you have no idea what her meaning is, then she says you wern't listening and is upset with you and swells up..........You can't win!

     

    Perhaps it is better if neither of you can speak to the other.

  14. Tsapper I'm guessing you got your AOS fee via e-mail in PDF format?

    Do they still use a bar code with that AOS invoice?

    Cut and paste Ha ha! I cut that bar code with scissors and pasted to the optin letter with glue. Scanned it and printed it and emailed it to the wife.

     

    For us I got an email with 2 PDF files (10/05/2010) one for DS-3032 and another for the AOS fee. I scanned the DS-3032 and letter to optin and emailed it to the wife with the barcode on it. She printed them signed them and scanned them and sent them back to me email. Make sure your wife keeps all originals with her signature safe for the interview. We did this for many forms and worked great for us. Then I saved as PDF and sent them to NVCElectronic@state.gov that same night I paid the AOS fee. Waited 3 or four days got my receipt for AOS and an invoice for the IV fee at the pay site. Some time after that I got an email we were in electronic processing and the GZO number.

     

    I stalled on the IV fee for the wife so the daughter's petition could catch up to the wife's then paid both IVs. You might need to do the same for your wife's to catch the son's???

     

    Also when the time comes if they do not send her a P-3 packet don't forget the P-3 supplemental form. It was not in the downloads at NVC because it is specific to GUZ Consulate. Just hand write in the answers in Chinese and English and send it back to them with the rest of your packet.

     

    Note: None of this rite cheer is advise only what werked for usins.

    They might not understand it is to cancel the ITIN as she has SS# now..?

    Anyway that's my concern.

     

     

    Yessir, I'd send in a paper or electronic return with your wife's SS # on it. My return goes to KAnsas City, you'res may as well, I don't know.

     

    The Texas center is where they approve of, and give ou the ITIN numbers. I wouldn't send them any tax forms as you've already sent them to the appropriate office for filing.

     

    Just send a letter with your wife's old ITIN number, her new SS#, and a statement asking them to cancel the ITIN number. THey will understand and you will be certain to be done with the ITIN number.

     

    The center your return goes to will figure out (if they even look at last years ITIN #) that your wife now has a SS#. IT's probably overkill to send a letter to Texas, but you will make for certain that the office that issued the ITIN number is the one who cancels it out.

    Additional ITIN Information

     

    What do I do when I am assigned a social security number (SSN)?

    Once you receive a SSN, you must use that number for tax purposes and discontinue using your ITIN. It is improper to use both the ITIN and the SSN assigned to the same person to file tax returns. It is your responsibility to notify the IRS so we can combine all of your tax records under one identification number. If you do not notify the IRS when you are assigned a SSN, you may not receive credit for all wages paid and taxes withheld which could reduce the amount of any refund due. You can visit a local IRS office or write a letter explaining that you have now been assigned a SSN and want your tax records combined. Include your complete name, mailing address, and ITIN along with a copy of your social security card and a copy of the CP 565, Notice of ITIN Assignment, if available. The IRS will void the ITIN and associate all prior tax information filed under the ITIN with the SSN. Send your letter to:
