Michael Posted June 15, 2010 Report Share Posted June 15, 2010 My friend Jeff is getting married to Chinese woman on June 26,2010.Here is his question. My fiance came to the US on Apr 29th. Her son did not accompany her but wants to come later. Can someone please tell me what he has to do since he has turned 18 since her arrival. Also what do we have to do on this end? What forms need to be filled out besides the I-485? He was included on her original K-1 visa application. Thanks,Michael Link to comment
dnoblett Posted June 15, 2010 Report Share Posted June 15, 2010 First for the son, the consulate needs to be contacted and K-2 packet needs to be sent out so that son can be processed and get a K-2 visa. K-2 MUST be requested within 1 year after the K-1 was granted. Since son is 18 at time of marriage, step parent cannot file an I-130 for a immigrant visa, the only option is K-2 follow to join. As for I-485.
