lucaskeli Posted March 9, 2005 Report Share Posted March 9, 2005 I just heard a rumor, that in China, when you have scheduled a K3 interview, if the Consulate has also received your I-130 CR-1 petition, that they will automatically convert your interview to one for a CR-1. Can anyone confirm or deny this? I was told this is specific to the U.S. Consulate in China. Lucas Link to comment

But as quick as I-130's are approved and forwarded to post these days, who knows?The federal register says an applicant can continue with the K-3 process once the DS-230 is submitted before the I-130 arrives at post. A K-3 applicant can switch to CR-1/IR-1 processing if they so choose.If the I-130 has already arrived at post then the applicant must proceed with CR-1/IR-1 processing and cannot switch to K-3.
