Before her status is adjusted to green card, can she go back to China so we can have the wedding ceremony? I read something about advance parole. 1) How do I apply for that?2) Is it a good idea?3) When should I apply for it? At the consulate? After she gets here? Thanks. Link to comment
frank1538 Posted February 8, 2005 Report Share Posted February 8, 2005 Advance Parole (AP) is needed between that period of time that your fiancee/wife is here but before she has been adjusted from K-1 to conditional permanent resident. Since the K-1 is good for only one entry into the US, she will not be able to enter a second time on the K-1 if she leaves before she has her green card. Take a look at http://uscis.gov/graphics/publicaffairs/ad...es/advisory.htm. A couple of points. You cannot apply for advance parole before you file for AOS. Most people apply for AP at the same time they apply for Adjustment of Status. This also means that you cannot apply for AOS until after you are married. Based on my experience, I think it is a very good idea to go ahead and apply for AP as soon as possible. Link to comment
