Green Card Ending/Citizenship Application

Greetings all... :bye1:

 

It seems that having a green card is nowhere near as secure as was once thought so the wife has finally agreed that she must become a USC...Here's the deal... :huh: Her GC expires in December 2018...I read that currently it is taking 5-8 months to get through the process after application...She is going to China in April until July so we cannot apply until she returns I expect...Bottom line is that her GC may have expired before she has gone through the Citizenship process...Is that a big problem... :yikes: or not... :gleam:

No - you simply file an I-90 for a replacement card. Her green card status doesn't expire. She DOES have the 10 yr card, RIGHT ??!?

If you want to look into avoiding the $455 fee for the I-90, read this and let us know how it turns out -

 

Applying for U.S. Citizenship With an Expired Green Card

It's usually best to renew your green card before you apply for naturalized U.S. citizenship - but it's not strictly required.
The INA says
Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him . . .. Any alien who fails to comply with [these provisions] shall be guilty of a misdemeanor ...

 

 

Seems like they said 5 or 6 months processing, but I'm not seeing where they said it.

Permanent residence status does not expire with the card, the rule is a person should file an I-90 to get a new card at their earliest convenience around or after it expires.

 

In your case, if filing an application for naturalization you could do so now and if the citizenship interview happens before the card expire date great, if not and it happens after that date, again it's not a big issue.

 

If really needing evidence of residency status, then file an I-90 around 90 days prior to expiration to get a new card, but it would suck to pay the $455 to get a new green card only to obtain citizenship around the same time the card gets replaced and then turn in that $455 greencard.

Thanks very much for the info guys... :flowers_and_kisses: It would seem we are pretty safe in applying in July for USC when her GC expires in December...Yes I would certainly want to avoid paying $455 for basically nothing... :angry: on top of the N-400 fee...

 

I could mail in the competed application while she is still in China but if she was called in for Biometrics before she got back it could be a problem and really set things back...

Greetings from Loon Lake in the Northwoods of Indianhead Country Wisconsin...We ultimately decided to renew the green card...A very simple process only made painful by having to fork over 540 sheckels to Uncle Sam... :( Li had her biometrics done yesterday in Duluth, MN, our nearest USCIS office...We were the only ones there and it took all of 10 minutes to finish up and get the Adit sticker attached to her GC which allows another year of use, or until the new card arrives...Otherwise all is well and hope everyone here is the same... :pash: :victory:

Yeah, I miss you you ole fart. I was just wondering about you yesterday. Not many of us left now. Mostly just guys looking for info to get their squeeze here and bam gone.

 

Have you found the biguns at Loon lake yet? How about that big Tarpin in Flrotida? We want pictures.

Hi Larry, Great to see you still hanging around...Being on the right side of dirt is a good thingmie, sad that Bobby and Carl and Mark are no longer with us... :(

 

I think I will never beat my grandfather's 6# 5 1/2 oz largemouth from up here...But I have that fish on my wall so it's okay... :)

 

The only BIG fish I've caught out of this little lake are 3 14" black crappies... :toot:

That's a nice un. Keep it up you never know what will happen. Buy some fish pellets and start feeding em. How's the wife doing? Still buying and selling houses in Chiner? I have a young dentist friend that loves all kind of game sports. Here is a couple of largemouth bass that he caught up near the Great Smokey Mountains where he lives. I hope that you can see them because the pictures file extension that they have I could not copy it and reproduce the pictures.

Unbelievable how quickly everything happened with our I-90...July 20 did Biometrics in Duluth...Today, July 28 got the new 10 year G/C...At the USCIS office they said issuing green cards was waaaaaaaaaaaaaaaaaaaayyyyyyyyyyyyyyyyyyy behind and it could take a YEAR to get it...A lot they know... :P

 

Li will eventually get her USC but she feels unready yet... :huh:

More than likely they confused the I-751 with the I-90

 

The I-751 for removal of conditions is taking a year or so to process the I-90 is simply an application for a replacement card so should be quick.
