I have a question - while we were waiting for approval of i-130 and so on our marrige had our 2nd year anniversary. Yesterday we got an email regarding the appointment for the interview. But in order to do that we have to chose the category of the visa. Do we have to select CR1 (as it mentioned at the i-130) or IR1 (because last week we had 2nd year anniversary)? dnoblett Posted January 27, 2017 Report Share Posted January 27, 2017 Select IR-1 since you are past 2 years of marriage. In any case they will automatically indicate the visa as IR-1 and even if the visa is noted CR-1 upon entry to the USA the green-card status will be set as IR-1. I have a friend that interviewed for visa before 2 years of marriage got a CR-1 and then waited to enter the USA the day after 2 years of marriage and the resulting green-card was IR-1 (10 years without conditions) Link to comment

Randy W Posted January 27, 2017 Report Share Posted January 27, 2017 Like Dan says, it's SUPPOSED to be automatic, but occasionally some Immigrations Officer doesn't get the memo. It's in your own best interest to FLAG your application as IR-1 when you have the opportunity, AND to keep a copy of the marriage certificate handy, both at the interview AND at the POE.
