Can wife's sister son come here to live?

Wife asked me to talk to lawyer to get her nephew to come here to live. He is 28 years old. Is this even possible? I guess I will call the lawyer and ask him but I thought I would ask here. She just got her 10 year green card. It does not matter to me. We have the room and I like her family. But I did not think a family member could come here and live just because they wanted to (from China to Tennessee).

Wife could petition for her parents... 10 years

Then, parent could become citizen .. 3 years

Then parent could petition for unmarried children .. another 10 years

 

I think its not a reasonable way to go, but better you have a lawyer say that than "I read it on the internet" or "Credzba said"

 

We have the same discussions, and like you I like my wifes family, but they can get 10 year visa to America, and come visit 6 months at a time way easier than trying for green card or citizenship.

Parents both not alive. Are you saying her nephew can get a ten year visa?

No way to directly petition for a neice or nephew.

 

Depending on nephews age, if file a petition for sibling, if nephew is less than 21 at time sibling petition is assigned a visa number, then nephew would qualify for a derivative visa. But since he is 28 that is not an option.

 

In order for your spouse to file a petition for her sibling she must first be a US Citizen. Green card holders are very limited on who they can petition for.

Only when wife is a US citizen, can she file an immigrant petition for her parents.

Per my observation, it takes about one year, the time length like a CR1.

One option would be for him to perhaps go to college at a nearby college, could live with you, and perhaps by chance he finds love and married a US citizen, then could adjust status that way,

I had thought about that and my wife said "I want to make sure she is a good woman!" My thinking she would be one of those large women you see at walmart. I think he has a girlfriend but parents (wifes sister and brother in law) said she does not have enough money or something else they don't like about her. Right now it is all on hold until she talks to her family. I told her any of her family could come here for 6 months. She said her sister wants to come but right now she does not want to pay the money for her. I would like all of them to come visit, I like them all but can not speak one word to them so mostly wave at the computer and say ni how!

Getting the visa is the hardest, but just need to show they have good reason to return to China.

I don't think they are near as hard to get as they have been in the past.

I was wondering what kind of evidence is best to show reason to return. My wife's single 30 year old daughter would like to come visit. She has a 5 year old daughter been divorced 2 years. She would come alone. She owns her own home and has a small business in China. Credzba, I see you said several of your wifes family were able to get the green card any advice?

Show the evidence she has. (credzba may or may not drop by in a reasonable time frame)
