Green Card error

Well, in three days we can apply for removal of conditions, and we're getting the paperwork ready to send. There is one question I sort of need an answer to, though. Not specifically related to the I-751.

 

When ChunMei last returned from China in June the immigration agent at LAX pointed out to her that her birth date on her green card didn't match the date on her passport. Her date of birth is 6-2-1963, and somehow on her green card they had entered it as 2-6-1963. She's been out of the country three times now, and this is the first time that anyone (including us) ever noticed it. ChunMei told the agent that in a couple of months we would be applying for the ROC, and the agent told her we could just wait until then and get it fixed on her 10 year green card.

 

My question is, how do we do that? Do I include a separate page detailing the problem, or what? I'm sort of lost here.

Easy way - fill out the I-751 with the correct birth date, and see if it doesn't show up on the permanent green card. Include a copy of her birth certificate.

 

More involved - make an InfoPass appt and ask the IO what date they have on file for her. You might bring a copy of her birth certificate to show the correct date, which he may or may not be able to fix there on the spot.

 

Still more involved - file an I-90 (either now or after you get the new card, if it still has the incorrect date) for a replacement card to show the correct date.

 

Seems like the best approach is to wait for the new card to see what it shows, and then file an I-90 if they screw it up (I believe it's free if it's their mistake).

Correct, no charge to file an I-90 if there is an error on the card. http://www.uscis.gov/i-90

 

I would make double sure it is correct on the I-751, and if card arrives with same error, then file an I-90 to correct it.
