ellis-island
Here is AILA's amicus brief in the Qiyu ZHANG matter before the Board of Immigration Appeals. http://www.aila.org/content/default.aspx?docid=30587 Like the issue of K4's, I think it's reasonable for a court to construe the intent of Congress as allowing age-outs to adjust status. I have been watching this issue closely. It seems some immigration judges have ruled that aged out K-2s can adjust status but lately there have been a couple of set backs and if I'm not mistaken the USCIS has appealed at least one case where the judge ruled in favor of the K-2 holder. I'm curious Marc, what do you think it will take to finally resolve this issue? There has been at least one immigration bill proposed that would rectify the situation but it doesn't seem to have gotten much traction. Link to comment
