Jan. 7th, we were told that our case was sent to GUZ on Jan.5th. On Jan. 9th, we were told it was held for "Determination of Request for Expediting". Expediting was requested by DHS Ombudsman, with a Priority Date of Nov. 24. 2006.

On Jan. 16th we were told the case was sent to GUZ with a Request for Expediting on Jan. 14th. Our case was never in the automated system.

Does GUZ "EXPEDITE" cases? Will our case be handled differently? as in delivery to the Consulate? What kind of time frame could we be looking at?

Who do we contact about the case now? DOS?

How soon will we be able to contact GUZ about the case? The last email answer from GUZ said, "we have not received your case, we can not answer any questions, GUZ." I did send another PM to USCONGUZ, but no reply yet. The first reply took 30 days.

hi mike... sounds like some uncharted territory to some degree... don't recall an expedited request like this before, but maybe someone has.

 

Did the request start at USCIS or at NVC?

 

I'd be inclined to:

1. Call NVC at least once to ask them if they show any 'expedited' request as part of the case; did they log it or can they see any update?

2. After what NVC says... I expect they won't have much to say but you never know.... A better bet is to stay in touch with DOS. I'd ask them the same basic questions to see the computers show... and ask them how you get updates, just call them back, etc.

The only expedited case I know was actually the fastest processing time I have ever seen, it started with the K-1 filing and cleared CSC and NVC in less about 3 weeks and sent to GUZ via diplomatic pouch. P-3 was sent 1 week later and when the forms were returned to GUZ it was given a fast track and P-4 was sent.

 

I'd check with DOS on the status of the case, if you are lucky it has bypassed the standard shipping method.

 

There is a new head of the visa unit, so it's uncertain how they will handle the request, but I'd bet if it shows up flagged for expedited processing they will move it to the front of the line.

Thanks for the info David and Lee, after fighting with USCIS for almost 1 year, I contacted the Dept. of Homeland Security, they got our petition delivered to the NVC, and requested that it be "EXPEDITED". During the almost 2 months that we were at the NVC, we had several small problems, 1 - We weren't prepared with all of the "ORIGINAL DOCUMENTS" for the NVC, Yizhen was in the US, we had to wait while her sisters got a new Police Report and sent it to us. 2 - When we tried to change Yizhen's address, they changed our file to show we were processing AOS in the States, it took 16 days to get that corrected.

During this time, the NVC told me that there was no "Expediting", and on Jan. 7, 2009, we were told on the phone that our file was sent to GUZ on Jan. 5th. Tried to call DOS, on Jan. 9th and we were told that our file was not sent to GUZ yet, that it was being held for "Determination of Request for Expediting" .

On Jan. 16th, NVC said our case was sent to GUZ with a request for "EXPEDITING".

Our case never was entered into the automated system, and I have sent a copies of the email with the Ombudsman's Request for "EXPEDITING", which includes the direct phone line to call the Ombudsman with any question's. I also included copies with the I-864, and the DS-230 packages.

We are hoping that the case was sent by Diplomatic Pouch, also. How will they contact us with the P-4? Hopefully we will have enough time to get to GUZ for the interview. Thanks again for the help and encouragement, Mike & Yizhen

Today, we got more bad news, I called DOS, and they said our case was sent via DHL on Jan. 5th, and I should call NVC to find out if they are sending the request to "EXPEDITE" to GUZ. I called NVC and was told that the file was sent before the determination of the request to expedite and it was to late. If it was to be expedited, it would have to be sent in a "POUCH" with the request. I sent an email to the IV section in GUZ, and got a reply in less than 6 hrs. They said that they received our case, and that it would take 3 or 4 months before we would hear from them. Their reply made no mention of the Request to Expedite.

I also sent an email to NVC, asking that they forward the request to GUZ and let them decide what if anything can be done. I included a copy of the email from the OMBUDSMAN requesting the "EXPEDITING". There is a name and a direct phone number to call the OMBUDSMAN with any questions, in the email. I also sent a PM to USCONGUZ asking them to EXPEDITE according to the Ombudsman's Request and included the same email copy. I feel like USCIS and NVC have caused most of our delays, but they are unwilling to help us, and they are just jerking us around.

We are near the end, we can wait if we must, Mike & Yizhen

I think I will contact the Ombudsman again also.
