Just about ready to file AOS package

Sorry guys.. Keep editing the darn post, as I am finding answers to my own questions..LOL . I guess I have all the ansers now as of 3/22

 

 

1/ Is the fingerprinting fee $ 25 or $50 ?

 

Update: found the answer : 50 bucks

 

2/ Apparently it has to be sent with the AOS. Correct?

 

Update: found the anwer: Yes. Appointment letter will come later

 

3/ Checks are made to the order of BCIS? ( Before they were made to INS )

 

Update: found the anwer: INS immigration fees for immigration services and benefits previously payable to the "Immigration and Naturalization Service" should no longer be made out to INS. They should now be made payable to the "Bureau of Citizenship and Immigration Services."

 

4/ I-765. EAD.. Some checklists say to send a "signature card", basically an index card with the signature on it. Any idea?

 

Update: Found the answer. The INS announced that the signature card which accompanied the Form I-765 is no longer required.

 

5/ Form I-765 part 16.. under the eligibility reference is it (a)(6) or ( c )(9) or both that need to be put down for a K-1 ? Form instructions are not too clear

 

Update: found the answer...(a)(6) is for the temporary EAD..( c )(9) is for the 1 year EAD

 

6/ When filing I-485 and I-765 is the SSN a must or marking "applied for on xx/xx/xx" acceptable if the number has not been issued yet?

 

Update: found the answer. You can call 800-772-1213 and they will give you your assigned SSN a few days after filing the SSN application, even though you haven't received the card yet. Yuhui's got her SSN over the phone

I am not clear on one step, for K1 visa holders, what forms are filed before marriage and which are after?

I-485 AND I-131 are filed after marriage only

 

I-765 ( code (a)(6) written in part 16 ) can be filed before marriage only... Temporary EAD

 

I-765 ( code( c )(9) written in part 16 ) can be filed after marriage only... One year EAD

Absolutely...It's a must. Write a6 in part 16 ONLY if you are asking for a temporary 90 days EAD ( it will expire with the K-1 ) . You have to be still single.

Write c9 instead when you are married only and want a permanent EAD

( usually filing AOS I-485 and I-765 at the same time.)

EAD stamp in passport might be nice, but experience shows that few employer really accept it. Technically a K1's is authorized to work, but still need BCIS permission through I-765. Her SS card will be stamped

" Authorized to work with BCIS authorization ", vs, a blank card for you and me or a card that says " NOT authorized to work "

Best is to file for I-765 a6 OR c9 status, but not BOTH.

DO NOT file a6 if you are already married

Eric did you just call S.S. office and apply , did you have to go down there with all your documents and everything , just asking , you are paving the way with the new information, this will make things easier :blink:

I went to office.. Filled out SS5 application. That's it. Bring passport.

It will take 6-8 weeks for the card to get there, as they have to check her documents with BCIS

we filed on 3/11 but received over the phone her pre-assigned SSN 10 days later... Go to www.ssa.gov for the 800 number. They will verify her identity over the phone. I suggest she calls, not you.

This way you already have a SSN you can use for banks etc... several weeks before the card actually shows up.

 

Then when she gets it ( if it was filed under a maiden name ), you can file another SS5 with a name change to married name. No biggie.

SSN will remain the same

I just tried to call 800, but the only information I got is the location and telephone number of the local SSN office. So I should call local SSN to ask if my ssn has been assigned?

I tried again, and finally I talked to one of the representatives. She told me that my number was not available yet. hmmmmm...why it took so long for me? She asked my name, birthday, current address, zipcode and phone number. It seems that my name has been entered in their system yet. I applied SSN on Mar. 10. I'm beginning to worry...

Yes do that. They should have it. Although I think Yuhui got hers thru that 800
