Greetings,

 

Mia arrived in america Saturday and today we went to our local SSN office to apply for a number for her. her application was taken without incident, although the San Francisco customs people hadn't entered her name into the computer yet, so they can't process until that happens. it may be two weeks or it may be a month.

 

However (and this is the interesting part) we were told that she could work immediately as her visa (K1) was authorized for work. Now, there was NO identification on the I-94 form to indiate one way or another, but this was her assertion.

 

So, good news.

well, we weren't turned away. They did say we would receive a SSN for her, but that because SFO hadn't entered her name in the DB yet, they'd check for 8 days before forwarding all the paperwork to the SF consulate. So, we may have a SSN in 2 weeks or 1 month....

 

Either way, it's in process.

This is due to SS administration memo EM-00154 of November 2000.

K-1 visa alone with a valid I-94 are ground to be issued a SSN.

However you will still need a EAD to actually work

And this is what confused me. The woman at SS said her I-94 authorized her to work. I looked puzzled and asked if she was sure. Looking again at our I-94, she said yes, Mia did have permission.... it must be that K-1 visas have temporary EAD until AOS application.

 

Or, i'm just crazy.

Yes it is confusing.

An employer will ask for a SSN.. SSN that can be issued without EAD, but this morning the SS office told us that the card issued would be

marked " authorized to work with immigration permit " or something to that effect,

I guess we'll just have to see... I did show her the EM-00154 memo for good measure though, although she sounded like she was perfectly aware of the new policy.
