K2 Follow to Join Procedure and Timing

May a K2, follow to join, attend the interview with the K1 from whom the K2 visa is derived and then delay receiving the K2 visa in their passport for up to 6 months to allow the prospective K2 to turn 18 and thus not need permission of the other parent to leave China?

 

Alternatively, may the K2 request an interview date separate from the K1 and delayed up to 6 months in order to allow the prospective K2 to turn 18 and thus not need permission of the other parent to leave China?

 

If either of the the above cases is permitted then, for the K2, is the "must immigrate within 12 months" rule applied from the date of the K1 visa or the later date of the K2 visa?

Dear CFL Member,

 

Either method of setting up a follow to join case for the K2 is OK. They can interview at the same time and then delay the issuance of the K2 or you can request that the K2 interview at a later date.

 

However, you are correct that the K2 must enter the U.S. within one year of the issuance date of the K1 visa.

As a follow up I would like to confirm whether or not a K-2 / K-4 needs permision from the divorced parent to follow the K-1 / K-3 parent if the K-2/ K-4 is over the age of 18.

As stated in a previous post, if the applicant is over the age of 18, then there should be no problem with custody issues.
